【摘要】：教材著作權(quán)人認為,同步教輔未經(jīng)許可依據(jù)其教材編寫,構(gòu)成著作權(quán)侵犯。教育部等部門的文件要求,根據(jù)他人享有著作權(quán)的教科書編寫出版同步教輔,應(yīng)依法取得授權(quán)。由此,教材利用其特殊的市場地位和著作權(quán)地位,有可能在授權(quán)過程中實施限制競爭的行為。對于特定教材的教輔市場而言,該教材可被稱為關(guān)鍵設(shè)施,它對下游的教輔市場具有先天的鎖定之效。我國教材具有公共產(chǎn)品屬性,著作權(quán)保護應(yīng)受限制�！斗磯艛喾ā房梢杂脕碇С轴槍滩闹鳈�(quán)的反壟斷規(guī)制;《著作權(quán)法》應(yīng)增設(shè)相關(guān)制度,禁止教材著作權(quán)人的壟斷行為。
[Abstract]:The copyright owner of teaching materials believes that synchronous teaching aids are compiled on the basis of their textbooks without permission and constitute copyright infringement. According to the requirements of documents of the Ministry of Education and other departments, synchronous teaching aids should be compiled and published according to textbooks in which others enjoy copyright. According to the law, the textbook should be authorized by law. As a result, it is possible for the textbook to restrict competition in the process of authorization by taking advantage of its special market position and copyright status. For the teaching auxiliary market of a particular textbook, the textbook can be called a key facility. It has an innate locking effect on the downstream teaching aid market. Chinese textbooks have the attribute of public goods. The protection of copyright should be restricted. Anti-monopoly Law can be used to support the anti-monopoly regulation of textbook copyright, and the copyright Law should establish relevant system to prohibit the monopolistic behavior of textbook copyright owners.
