【摘要】：船員外派機(jī)構(gòu)法律定位之確立是規(guī)范船員外派管理,維護(hù)外派船員合法權(quán)益的重要問題之一。在厘清學(xué)界對(duì)船員外派機(jī)構(gòu)法律地位所形成的"中介說""用人主體說"以及"折衷說"三個(gè)理論的基礎(chǔ)上,分析其不確定性所帶來的相應(yīng)困境及原因。借鑒域外國家的相關(guān)立法規(guī)范,提出"協(xié)商折衷說"理論,確定船員外派機(jī)構(gòu)法律地位要以充分的協(xié)商為前提,并在《中華人民共和國海員外派管理規(guī)定》中規(guī)定外派船員獲得相應(yīng)的咨詢及建議的權(quán)利。
[Abstract]:The establishment of the legal orientation of the crew assignment organization is to standardize the management of the crew assignment, One of the important issues of safeguarding the legitimate rights and interests of the expatriate crew members. On the basis of clarifying the three theories of "intermediary theory" and "eclectic theory" formed by the academic circles on the legal status of the seafarers' expatriate organizations, This paper analyzes the corresponding difficulties and reasons brought about by its uncertainty, draws lessons from the relevant legislation and norms of foreign countries, puts forward the theory of "negotiation compromise", and determines the legal status of the seafarers' expatriate agencies on the premise of full consultation. In the regulations of the people's Republic of China on the Administration of Seafarers' assignment, it is stipulated that the expatriate crew shall have the right to obtain the corresponding advice and advice.
