論互聯(lián)網(wǎng)金融的私法規(guī)制——以大學(xué)生網(wǎng)絡(luò)信貸消費(fèi)合同的效力問題為例

【摘要】:互聯(lián)網(wǎng)金融的私法規(guī)制側(cè)重于糾紛解決、權(quán)益救濟(jì)與規(guī)則塑造,在產(chǎn)業(yè)需要、社會(huì)效果和法律實(shí)施等多個(gè)層面均有公法規(guī)制不可替代的價(jià)值與優(yōu)勢(shì)。以"電商+網(wǎng)貸"為代表的大學(xué)生網(wǎng)絡(luò)信貸消費(fèi)迅猛發(fā)展、"雙刃劍"效應(yīng)突出,而當(dāng)下強(qiáng)化公法規(guī)制的效果有限且負(fù)外部性明顯,應(yīng)探索相應(yīng)的私法規(guī)制路徑。大學(xué)生在法定層面的民事行為能力與其在實(shí)踐層面的消費(fèi)認(rèn)知能力之間存在不同程度的落差。應(yīng)采取類型化規(guī)制的方法,針對(duì)特定范圍的商品和服務(wù),從合同法的角度將與大學(xué)生消費(fèi)認(rèn)知能力明顯不相適應(yīng)的買賣合同歸結(jié)為效力待定合同,并從消費(fèi)者權(quán)益保護(hù)法的角度適當(dāng)延長(zhǎng)大學(xué)生行使合同解除權(quán)的時(shí)限。
[Abstract]:Private law regulation of Internet finance focuses on dispute resolution, rights and interests relief and rule shaping, which is needed in industry. Social effect and law enforcement have irreplaceable value and advantage of public law regulation. With the rapid development of college students' network credit consumption, the effect of "double-edged sword" is prominent. At present, the effect of strengthening the regulation of public law is limited and negative externality is obvious. It is necessary to explore the corresponding path of private law regulation. There is a difference between the civil behavior capacity of college students at the legal level and their consumption cognitive ability at the practical level. For a specific range of goods and services, from the point of view of contract law, the sale contract, which is obviously incompatible with college students' consumption cognitive ability, is reduced to a valid pending contract. And from the angle of consumer rights and interests protection law, the time limit for college students to exercise the right to rescind the contract is properly extended.
