【摘要】：當(dāng)今社會(huì),人們對(duì)生活質(zhì)量的要求不斷提升,觀看各類影視作品成為時(shí)興的娛樂休閑方式,小小的熒幕卻承載著人生百態(tài),演繹著世間悲歡離合。網(wǎng)絡(luò)技術(shù)下的影視產(chǎn)業(yè),發(fā)展勢(shì)頭更加強(qiáng)勁,發(fā)展空間更加廣闊。然而繁榮的背后也存在一些問題值得關(guān)注。由于網(wǎng)絡(luò)環(huán)境所具有的特殊性,影視作品著作權(quán)遭到侵權(quán)的現(xiàn)象日益嚴(yán)重,司法保護(hù)難以達(dá)成共識(shí)而屢屢受挫,如何確定管轄法院、賠償金額,如何分析侵權(quán)行為構(gòu)成,如何認(rèn)定事實(shí)、采納證據(jù)等,諸多問題值得研究并亟待訴訟參與的各方主體予以澄清。本文即在此背景下,以影視作品網(wǎng)絡(luò)傳播侵權(quán)為切入點(diǎn),以求全面、準(zhǔn)確分析侵權(quán)判定涉及的主要問題。本文遵循“提出問題—分析問題—解決問題”的論文基本模式,采取“總—分—總”的論證結(jié)構(gòu),以統(tǒng)一的論點(diǎn)為主線,每章圍繞各自的分論點(diǎn)展開,最后落實(shí)到問題及對(duì)策的總結(jié)。第一部分作為“總論”,主要是梳理相關(guān)邏輯關(guān)系,明確研究的問題及方向。第二部分是“分論”,對(duì)影視作品網(wǎng)絡(luò)傳播侵權(quán)案件重點(diǎn)、難點(diǎn)問題進(jìn)行分析。第三部分是“結(jié)論”,針對(duì)問題的癥結(jié)點(diǎn),結(jié)合我國(guó)相關(guān)法律規(guī)定,探尋妥善解決的思路,并且根據(jù)司法認(rèn)定對(duì)利益相關(guān)者的行動(dòng)策略進(jìn)行法律評(píng)析,提出合理的建議。
[Abstract]:In today's society, people's demands on the quality of life are constantly rising. Watching various kinds of film and television works has become a popular entertainment and leisure mode, while the small screen is carrying a hundred states of life and deducing the world's joys and sorrows. The film and television industry under the network technology, The momentum of development is stronger and the space for development is wider. However, there are also some problems behind the prosperity that deserve attention. Due to the particularity of the network environment, the phenomenon of copyright infringement of film and television works is becoming increasingly serious. Judicial protection is difficult to reach a consensus and is often frustrated. How to determine the jurisdiction of the court, the amount of compensation, how to analyze the constitution of the infringement, how to identify the facts, how to adopt the evidence, etc. Many problems are worth studying and need to be clarified by the parties involved in the litigation. In this context, this paper takes the infringement of the network communication of the film and television works as the starting point, in order to achieve a comprehensive, This paper follows the basic model of "posing problem-analyzing problem-solving problem", adopts the argumentation structure of "total-divided-total", and takes the unified argument as the main line. Each chapter revolves around their respective sub-arguments, and finally implements to the question and the countermeasure summary. The first part as "the general theory", mainly combs the correlation logic relation, The second part is "the theory of division", analyzes the focus and difficulty of the infringement cases of the network communication of film and television works. The third part is the "conclusion", aiming at the crux of the problem, combining with the relevant laws and regulations of our country, This paper explores the idea of proper solution, and makes a legal evaluation of the stakeholders' action strategies according to judicial cognizance, and puts forward some reasonable suggestions.
