【摘要】：建筑業(yè)是我國國民經(jīng)濟(jì)支柱產(chǎn)業(yè)之一,對(duì)國家社會(huì)經(jīng)濟(jì)的發(fā)展做出了巨大貢獻(xiàn)。為了規(guī)范建筑市場(chǎng)秩序,我國對(duì)建筑領(lǐng)域?qū)嵭惺袌?chǎng)準(zhǔn)入制度,將不具備相應(yīng)資質(zhì)的企業(yè)及個(gè)人擋在門外,但出于建筑市場(chǎng)高額利潤(rùn)的吸引,建筑工程非法掛靠、非法轉(zhuǎn)包現(xiàn)象成為建筑市場(chǎng)的一大“頑癥”。在建筑工程掛靠、轉(zhuǎn)包施工中,實(shí)際施工人對(duì)外以建筑公司名義簽訂買賣、租賃合同而引發(fā)的民事糾紛呈高發(fā)態(tài)勢(shì),不少建筑公司因此陷入訴訟泥潭。對(duì)于該類案件的責(zé)任承擔(dān),法律未做明確規(guī)定,各級(jí)法院裁判尺度不一,由此造成訴訟對(duì)抗激烈。如何正確使用法律解決這類案件的責(zé)任認(rèn)定問題,有效平衡各方利益,并進(jìn)而發(fā)揮司法裁判規(guī)范建筑行業(yè)市場(chǎng)秩序的能動(dòng)作用,是目前該領(lǐng)域司法實(shí)踐亟待解決的問題。
[Abstract]:The construction industry is one of the pillar industries of our national economy, which has made great contributions to the development of national social economy. In order to standardize the order of the construction market, our country implements the market access system in the construction field. Enterprises and individuals who do not possess the corresponding qualifications are kept out of the door, but due to the attraction of high profits in the construction market, construction projects are illegally linked to each other, and illegal subcontracting phenomenon has become a major "stubborn disease" in the construction market. The actual constructors sign sales in the name of the construction companies, and the civil disputes caused by the lease contracts are in a high incidence, and many construction companies are in the quagmire of litigation. The law does not explicitly stipulate the liability of this kind of cases. Courts at all levels have different judgment criteria, resulting in fierce litigation. How to correctly use the law to solve the problem of liability determination in such cases, and effectively balance the interests of all parties, And then exerting the active role of the judicial decision to standardize the order of the construction industry market, which is the urgent problem to be solved in the field of judicial practice at present.
