【摘要】：隨著科技的不斷發(fā)展,社會的信息化,移動互聯(lián)網(wǎng)行業(yè)迅速崛起,手機軟件技術(shù)也隨之發(fā)展起來,成為了當下社會最流行的行業(yè)。究其原因不僅是因為手機軟件在生產(chǎn)生活中給人們帶來的方便,更重要的原因在于它能給人們帶來豐厚的利潤,旦由于手機軟件的開放性和易復制的特點,使得手機軟件的侵權(quán)現(xiàn)象十分嚴重,不僅給企業(yè)個人都造成了巨大損失,也對移動互聯(lián)網(wǎng)行業(yè)的發(fā)展起到了阻礙作用。因此,解決手機軟件的知識產(chǎn)權(quán)保護問題在當代社會不可回避。在我國,并沒有專門的關(guān)于手機軟件知識產(chǎn)權(quán)保護法,對手機軟件給予保護一般都是參照計算機軟件或者其他的保護方式對其進行,比如商標法、著作權(quán)法、公司法中有關(guān)保護商業(yè)秘密的法律條文。但在實踐當中,人們發(fā)現(xiàn)著作權(quán)法、商標法、反不正當競爭法等這些法律的保護手段對手機軟件知識產(chǎn)權(quán)的保護都存在一定的缺陷,即不能保護手機軟件所有者的合法權(quán)益鼓勵發(fā)明創(chuàng)造。在國外,許多國家早已將手機軟件知識產(chǎn)權(quán)作為重點保護對象,許多國家在經(jīng)過理論研究和實踐后,采用了申請APP專利來保護手機軟件這一種保護手段,并取得了一定效果。我國對于手機APP軟件的知識產(chǎn)權(quán)保護還處于起步階段,運用專利法保護手機APP的相關(guān)知識產(chǎn)權(quán)還存在許多問題,因此,對完善有關(guān)APP專利保護的立法及明確有關(guān)APP專利申請的客體進行研究具有重要的現(xiàn)實意義。
[Abstract]:With the continuous development of science and technology, the information of society, the rapid rise of the mobile Internet industry, mobile phone software technology has also developed. It has become the most popular industry in our society. The reason is not only because of the convenience that mobile phone software brings to people in production and life, but also because it can bring people a lot of profits. Due to the openness and easy replication of mobile phone software, the infringement of mobile phone software is very serious, which not only causes huge losses to individual enterprises, but also hinders the development of mobile Internet industry. It is inevitable to solve the problem of intellectual property protection of mobile phone software in contemporary society. In China, there is no special law on the protection of intellectual property rights of mobile phone software. The protection of mobile phone software is generally carried out by reference to computer software or other means of protection, such as trademark law, copyright law, company law on the protection of trade secrets. But in practice, People have found that copyright law, trademark law, anti-unfair competition law and other legal means of protecting mobile phone software intellectual property rights have certain defects. That is, unable to protect the legitimate rights and interests of mobile phone software owners to encourage invention and creation. In foreign countries, many countries have already taken mobile phone software intellectual property as the focus of protection. After theoretical research and practice, many countries, The application for APP patent to protect mobile phone software is adopted, and some results have been obtained. The intellectual property protection of mobile phone APP software in our country is still in its infancy. There are still many problems in using patent law to protect the intellectual property of mobile phone APP. Therefore, it is of great practical significance to perfect the legislation of APP patent protection and clarify the object of APP patent application.
