【摘要】:近年來未成年明星的人格權(quán)商業(yè)化利用的現(xiàn)象呈現(xiàn)井噴式增長和產(chǎn)業(yè)化發(fā)展的趨勢,為未成年明星本人及其經(jīng)紀(jì)公司、監(jiān)護(hù)人及商家等都帶來了可觀的商業(yè)利益。但由于未成年明星的民事行為能力受限,加上未成年明星身心的特殊性,心智上、社會經(jīng)驗上、對不利影響的認(rèn)識程度上的不足,其人格權(quán)商業(yè)化利用存在普遍被侵權(quán)的情況。而相關(guān)政策法規(guī)的缺位和學(xué)界的意見分歧加劇了這一情況。因此,無論是基于人格權(quán)本身的內(nèi)在要求——權(quán)利屬性要求,還是基于保護(hù)未成年明星的要求,或者是從公序良俗的角度出發(fā),都有對未成年明星人格權(quán)商業(yè)化利用加以合理規(guī)范性限制的需要。本文從實踐出發(fā),對未成年明星人格權(quán)商業(yè)化的利用進(jìn)行類型化的剖析,在對未成年明星及其特殊的身心特點進(jìn)行分析之后,在比較法研究的基礎(chǔ)上,提出對未成年明星人格權(quán)商業(yè)化利用限制的基本原則分為兩類,一類是以未成年人利益最大化為中心的未成年保護(hù)類原則;一類是以公序良俗為中心的人格權(quán)限制原則。基于以上原則,本文根據(jù)未成年明星人格權(quán)的類型化,針對不同人格權(quán)的商業(yè)化利用,詳細(xì)闡述了具體的限制內(nèi)容及其操作方式,并最終從未成年人保護(hù)法修訂和未成年明星保護(hù)機制的建構(gòu)角度提出了對未成年明星人格權(quán)商業(yè)化利用進(jìn)行限制的完善建議。本文分為三章。第一章是問題的提出及概念的厘清,首先提出了本文的研究問題,對國內(nèi)外研究現(xiàn)狀做了概述,對相關(guān)概念進(jìn)行了相近概念的辨析及對比,并對選擇進(jìn)行基礎(chǔ)理論構(gòu)建的三個概念——未成年明星、人格權(quán)商業(yè)化利用和限制進(jìn)行了界定和論證。第二章明確了問題的內(nèi)容,并對未成年明星人格權(quán)商業(yè)化利用的主體、客體、內(nèi)容和利用方式進(jìn)行了類型化的梳理,為下文論述提供了基礎(chǔ)的框架支撐。第三章回歸問題,回應(yīng)了對未成年明星人格權(quán)商業(yè)化利用是否需要限制,為什么要限制這些問題,并通過主體的特殊性來論證正當(dāng)性;以無限制的危害性來論證緊迫性和必要性。然后在此基礎(chǔ)上,回答了以下問題:限制哪些主體?限制哪些權(quán)利的商業(yè)性使用?以什么原則和標(biāo)準(zhǔn)進(jìn)行限制?依據(jù)哪些現(xiàn)行法律進(jìn)行限制?還需要增加什么制度設(shè)計來進(jìn)行限制?限制的目的何如?本文通過回應(yīng)這些問題,結(jié)合比較法分析,針對在未成年明星人格權(quán)商業(yè)化過程中的每一個主體、每一種具體人格權(quán)的限制進(jìn)行了細(xì)化,具體構(gòu)建起了未成年明星人格權(quán)商業(yè)化利用的限制體系,并建議從立法上采用特別立法或特殊條款進(jìn)行規(guī)定,明確權(quán)利邊界、設(shè)置后悔權(quán),并設(shè)定差別化的限制方式;從司法上,堅持因案制宜,但價值傾向應(yīng)當(dāng)統(tǒng)一;從體制上,建議建立專門的未成年明星行業(yè)協(xié)會和監(jiān)督機構(gòu),堅持立法、司法、行業(yè)協(xié)會、未成年人保護(hù)組織、家庭、學(xué)校多方聯(lián)動,以構(gòu)建完整的未成年明星人格權(quán)商業(yè)化利用的限制制度。
[Abstract]:In recent years, the phenomenon of commercial utilization of personality rights of underage stars has shown a trend of blowout growth and industrialization development, for the underage stars themselves and their brokerage companies. Guardians and businesses have brought considerable commercial benefits. However, due to the limited civil capacity of underage stars, coupled with the particularity of their bodies and minds, their mental and social experiences, the extent of their understanding of the adverse effects is insufficient. The commercial use of personality rights is generally infringed, and the absence of relevant policies and regulations and the differences of opinion in academic circles aggravate this situation. Therefore, whether based on the inherent requirement of personality rights-the property of rights, Or is it based on the requirement of protecting the minor star, or from the angle of public order and good custom, there is the need to restrict the commercial use of the personality right of the minor star reasonably and normatively. On the basis of comparative study, this paper analyzes the commercial use of personality rights of underage stars, and analyzes the characteristics of juvenile stars and their special physical and mental characteristics. The basic principles of limiting the commercial use of personality rights of minor stars are divided into two categories: one is the minor protection principle centered on the maximization of the interests of minors; One is the restriction principle of personality right centered on public order and good custom. Based on the above principles, according to the typology of personality right of underage star, aiming at the commercial utilization of different personality right, this paper elaborates the concrete restriction content and its operation mode. And finally from the minor protection law revision and the minor star protection mechanism construction angle proposed to the minor star personality right commercialization use to carry on the consummation proposal. This article is divided into three chapters. The first chapter is the question raised. The clarification of concepts, First of all, it puts forward the research problems of this paper, summarizes the current research situation at home and abroad, differentiates and compares the related concepts, and makes a comparison of the three concepts of choosing the underage star, which is constructed by the basic theory. The second chapter clarifies the content of the problem, and sorts out the subject, object, content and utilization mode of the commercial use of personality right of the minor star. The third chapter is the regression problem, which responds to whether the commercial use of personality rights of underage stars need to be restricted, why to restrict these problems, and to demonstrate the legitimacy through the particularity of the subject; On the basis of the discussion of the urgency and necessity of the harmfulness of unlimited limitation, the following questions are answered: which subjects are restricted? Which rights are restricted for commercial use? What principles and standards are used to limit this? Under what existing laws are restrictions imposed? What additional system design is needed to limit this? The purpose of restriction He Ru? In response to these questions, combined with comparative analysis, this paper focuses on each subject in the process of commercializing the personality rights of underage stars, and the limitations of each specific personality right. It constructs the restriction system of the commercial use of the personality right of the minor star, and proposes to adopt special legislation or special clause to stipulate in the legislation, clear the right boundary, set up the right of regret, and set up the differential restriction mode; From the judicial point of view, we should stick to the case system, but the tendency of value should be unified; institutionally, we should set up special associations and supervisory bodies for underage star industries, uphold legislation, judicature, trade associations, organizations for the protection of minors, and families, In order to construct a complete restriction system of commercial utilization of personality right of underage stars, schools are linked in many ways.
