【摘要】：隨著監(jiān)護(hù)性質(zhì)和監(jiān)護(hù)理念的演變,各國(guó)紛紛加入了監(jiān)護(hù)立法改革的行列。老年人的權(quán)益保護(hù)引起了廣泛關(guān)注。成年人意定監(jiān)護(hù)監(jiān)督制度正是在這樣的大修法背景下誕生的。成年人意定監(jiān)護(hù)監(jiān)督通過(guò)國(guó)家干預(yù)使民事主體行使民事權(quán)利時(shí)承擔(dān)相應(yīng)的公法義務(wù)或者由國(guó)家直接承擔(dān)保護(hù)弱勢(shì)群體的義務(wù),達(dá)到個(gè)人利益與公共利益的一致,最終實(shí)現(xiàn)實(shí)質(zhì)正義。眾所周知,我國(guó)已經(jīng)進(jìn)入了老齡化社會(huì)。我國(guó)《老年人權(quán)益保障法》已將成年人意定監(jiān)護(hù)制度納入其中,但是并沒(méi)有涉及成年人意定監(jiān)護(hù)監(jiān)督制度。加強(qiáng)對(duì)監(jiān)護(hù)制度的國(guó)家干預(yù)已經(jīng)成為監(jiān)護(hù)制度發(fā)展的趨勢(shì),建立完善的監(jiān)護(hù)監(jiān)督制度也已經(jīng)成為現(xiàn)代各國(guó)監(jiān)護(hù)立法的通例。英美法系的英國(guó)、美國(guó),大陸法系的日本、德國(guó)、韓國(guó)等國(guó)家都建立了相對(duì)成熟完善的意定監(jiān)護(hù)監(jiān)督體制。作為老齡化加速前進(jìn)的我國(guó),在監(jiān)護(hù)立法方面還有較大欠缺。我國(guó)的成年人監(jiān)護(hù)監(jiān)督體制對(duì)監(jiān)督的主體、監(jiān)督內(nèi)容、監(jiān)督措施等方面并沒(méi)有明確規(guī)定。鑒于該制度廣泛的利用群體以及日益加劇的老齡化現(xiàn)象,我國(guó)應(yīng)當(dāng)建立與成年人意定監(jiān)護(hù)制度相配套實(shí)施的監(jiān)護(hù)監(jiān)督制度。本文旨在通過(guò)對(duì)國(guó)外成年人意定監(jiān)護(hù)監(jiān)督制度的深入研究,嘗試構(gòu)架適合我國(guó)的意定監(jiān)護(hù)監(jiān)督制度。本文共分為四部分,具體內(nèi)容如下：第一部分是成年人監(jiān)護(hù)監(jiān)督制度概述。主要通過(guò)介紹監(jiān)護(hù)監(jiān)督制度的起源、形成和發(fā)展,成年人意定監(jiān)護(hù)監(jiān)督的必要性探究等方面為全文的論述作理論鋪墊。第二部分是成年人意定監(jiān)護(hù)監(jiān)督制度結(jié)構(gòu)體系。該部分通過(guò)系統(tǒng)、全面的論述成年人意定監(jiān)護(hù)監(jiān)督的主體、啟動(dòng)、對(duì)象、監(jiān)督主體的權(quán)限與職責(zé)、監(jiān)督時(shí)遵守的原則,期望更直觀的展現(xiàn)意定監(jiān)護(hù)監(jiān)督制度的結(jié)構(gòu)特色。通過(guò)該章介紹,以充分了解當(dāng)代監(jiān)護(hù)制度較為發(fā)達(dá)的各國(guó)是如何保護(hù)老年人這一特殊群體的。第三部分是成年人意定監(jiān)護(hù)監(jiān)督制度對(duì)我國(guó)的啟示。國(guó)外先進(jìn)的制度規(guī)定為我國(guó)嘗試構(gòu)建成年人意定監(jiān)護(hù)監(jiān)督制度提供了重要參考,更為我國(guó)監(jiān)督模式的選擇指明了方向。第四部分是我國(guó)成年人意定監(jiān)護(hù)監(jiān)督制度的構(gòu)建。該章參照國(guó)外相對(duì)成熟的制度規(guī)定及國(guó)內(nèi)外學(xué)者的研究成果,并結(jié)合我國(guó)的現(xiàn)狀,嘗試構(gòu)建適合我國(guó)的成年人意定監(jiān)護(hù)監(jiān)督制度。
[Abstract]:With the evolution of the nature of guardianship and the concept of guardianship, Countries have joined the ranks of the reform of guardianship legislation. The protection of the rights and interests of the elderly has aroused widespread concern. The adult custody supervision system was born under the background of such overhaul law. After state intervention, the civil subject assumes the corresponding public law obligations when exercising civil rights, or the state directly assumes the obligation to protect the vulnerable groups, It is well known that our country has entered an aging society. The Law on the Protection of the Rights and interests of the elderly in our country has included the system of custody of adults in the system. However, it does not involve the supervision system of guardianship decided by adults. Strengthening the state intervention in guardianship system has become the trend of the development of guardianship system. The establishment of a sound guardianship supervision system has also become the general rule of guardianship legislation in modern countries. South Korea and other countries have established a relatively mature and perfect supervision system of determined guardianship. As an aging and accelerating country, China is still lacking in guardianship legislation. The adult guardianship supervision system of our country has the main body of supervision and the content of supervision. In view of the widespread use of the system and the increasing ageing of the system, Our country should establish the guardianship supervision system which is compatible with the adult guardianship system. The purpose of this paper is to make a thorough study of the foreign adult free guardianship supervision system. This paper is divided into four parts: the first part is an overview of adult guardianship supervision system, mainly by introducing the origin, formation and development of guardianship supervision system. The second part is the structure system of adult free determination guardianship supervision system, which, through the system, comprehensively discusses the main body of adult determination guardianship supervision. Starting, object, the authority and responsibility of the subject of supervision, the principle of supervision, hoping to show more intuitively the structural features of the supervision system of determined guardianship. In order to fully understand the contemporary guardianship system more developed countries are how to protect the elderly this special group. The third part is the adults determined guardianship supervision system to our country. It provides an important reference to construct the supervision system of adult determined guardianship. The 4th part is the construction of the supervision system for adults in China. This chapter refers to the relative mature regulations of foreign countries and the research results of domestic and foreign scholars, and combines the present situation of our country. This paper tries to construct the supervision system of adult choice guardianship suitable for our country.
