【摘要】:業(yè)主團(tuán)體是我國進(jìn)行房改之后出現(xiàn)的一個(gè)新概念,實(shí)際上是小區(qū)各個(gè)業(yè)主為了實(shí)行個(gè)人利益和共同利益聚集起來管理小區(qū)事務(wù)的組織。各國立法對此有著不同的稱謂,法國《住宅分層所有權(quán)法》稱之為協(xié)同管理團(tuán)體;德國《住宅所有權(quán)法》稱之為住宅所有權(quán)人共同關(guān)系團(tuán)體,即住宅所有人共同體;日本《建筑物區(qū)分所有權(quán)法》將業(yè)主團(tuán)體按性質(zhì)的不同分為三類:管理團(tuán)體、管理組合法人及社區(qū)管理團(tuán)體。雖然各國立法的稱謂不同,但它的出現(xiàn)無疑對各國民法特別是建筑物區(qū)分所有權(quán)領(lǐng)域有著重大的意義。上世紀(jì)80年代商品房市場化趨勢逐漸加強(qiáng),各城市小區(qū)的數(shù)量、規(guī)模呈擴(kuò)張的態(tài)勢,人們的居住方式發(fā)生了巨大的變化,由以往獨(dú)門獨(dú)院的居住方式演變?yōu)榫奂谝黄鸬纳罘绞。業(yè)主購買小區(qū)的房產(chǎn)后,除了需要處理專有部分所有權(quán)的關(guān)系,還因?yàn)楣灿貌糠值拇嬖谛枰幚砼c其他業(yè)主的關(guān)系即共用部分持份權(quán)。這種不同于以往的法律關(guān)系的出現(xiàn)為使得小區(qū)的管理更具復(fù)雜性。本文運(yùn)用比較分析、實(shí)證研究的方法,從業(yè)主團(tuán)體自治的相關(guān)概念入手,敘述業(yè)主團(tuán)體進(jìn)行管理需要遵守的原則和發(fā)揮的作用,然后運(yùn)用政治學(xué)、社會(huì)學(xué)、民法學(xué)理論分析其理論的正當(dāng)性,同時(shí)結(jié)合國外立法論述其自治的內(nèi)容,包括進(jìn)行管理的內(nèi)容、業(yè)主公約、業(yè)主團(tuán)體的運(yùn)行等內(nèi)容,在上述理論的基礎(chǔ)上分析我國當(dāng)前業(yè)主團(tuán)體自治所面臨的一系列問題,如業(yè)主團(tuán)體法律定性的缺失、業(yè)主團(tuán)體與物業(yè)公司的關(guān)系定位不當(dāng)?shù)葐栴}。通過揭示我國業(yè)主團(tuán)體自治存在的不同問題,提出相關(guān)建議和措施,以期能夠豐富其理論,解決實(shí)踐中出現(xiàn)的部分問題,充分發(fā)揮出業(yè)主團(tuán)體在私法領(lǐng)域的功能和作用。
[Abstract]:The owners group after China's housing reform is the emergence of a new concept, is actually the plot each owners to implement individual interests and the common interests together the management of district affairs organization. Although the legislation title, but it's undoubtedly of civil law especially buildings the distinction between ownership of the field is of great significance. This paper uses comparative analysis, empirical research methods, starting from the relevant concepts of the owners of autonomous group, the owners group management should abide by the principles and the role and use of political science, sociology, analysis the legitimacy of its theory of civil law the theory, combined with foreign legislation and discusses its autonomous content, including the content of the management, the Convention on the owners, owners group operation etc., in the theoretical basis Analysis of a series of problems in China's current owners autonomous group facing the basis, such as the lack of legal owner group qualitative, positioning the relationship between owners and property companies group improper. By revealing the different problems of our owners autonomous group, puts forward relevant suggestions and measures, in order to enrich the theory and solve the problems arising in practice, give full play to the function and role of the owners group in the field of private law.
