【摘要】：面對(duì)國(guó)外專利主張實(shí)體的不斷入侵以及本土專利主張實(shí)體的出現(xiàn),有必要對(duì)專利主張實(shí)體現(xiàn)象進(jìn)行深入的分析。論文在充分分析其經(jīng)營(yíng)模式以及訴訟策略的基礎(chǔ)上,結(jié)合國(guó)外相關(guān)做法,提出了我國(guó)規(guī)制專利主張實(shí)體行為的對(duì)策和建議。 論文主要分為四個(gè)部分,第一部分是對(duì)相關(guān)概念的界定。通過(guò)對(duì)NPE(Non-Practing Entities)、PAE(Patent Assertion Entities)、專利流氓等相關(guān)概念進(jìn)行界定,以確定本文的研究對(duì)象；第二個(gè)部分對(duì)專利主張實(shí)體的經(jīng)營(yíng)方式以及利弊影響進(jìn)行分析。專利主張實(shí)體主要的經(jīng)營(yíng)方式是專利開發(fā)、專利購(gòu)買和專利訴訟。其中專利訴訟是專利主張實(shí)體的最主要的經(jīng)營(yíng)方式,主要的訴訟方式是訴訟威脅和直接訴訟。在分析其經(jīng)營(yíng)模式的基礎(chǔ)上進(jìn)一步分析了他所帶來(lái)的影響,主要從對(duì)企業(yè)、對(duì)訴訟規(guī)模以及對(duì)創(chuàng)新的影響來(lái)具體闡述；第三個(gè)部分介紹的是美國(guó)應(yīng)對(duì)專利主張實(shí)體的措施。通過(guò)對(duì)美國(guó)相關(guān)法案、政策的研究,可以得知美國(guó)主要是從限制提起專利訴訟的資格、合理適用禁止令條款、合理配置訴訟費(fèi)用等這些方面來(lái)規(guī)制專利主張實(shí)體提起的惡意訴訟；第四部分在分析了我國(guó)應(yīng)對(duì)專利主張實(shí)體行為必要性的基礎(chǔ)上,借鑒美國(guó)的相關(guān)做法,提出我國(guó)應(yīng)對(duì)專利主張實(shí)體行為的相關(guān)對(duì)策。
[Abstract]:In the face of the foreign patent entity invading and the appearance of local patent entity, it is necessary to analyze the phenomenon of patent claim entity deeply. Combined with the relevant practices abroad, this paper puts forward the countermeasures and suggestions for regulating the entity behavior of patent claims in China. The paper is divided into four parts, the first part is the definition of the related concepts. By defining the related concepts, such as NPE(Non-Practing entities, patent hooligans and so on, the research object of this paper is determined. The second part analyzes the operation mode of patent entity and its advantages and disadvantages. The main mode of operation of patent claim entity is patent development. Patent purchase and patent litigation. Among them, patent litigation is the most important business mode of patent claims entity, and the main way of litigation is litigation threat and direct litigation. On the basis of analyzing its business model, it further analyzes its influence. Mainly from the aspects of enterprises, the scale of litigation and the impact on innovation. The third part introduces the measures taken by the United States to deal with patent claims entities. Through the research on the relevant laws and policies of the United States, It can be known that the United States mainly from the limitation of patent litigation qualification, reasonable application of prohibition order clause, reasonable allocation of litigation costs and other aspects to regulate the patent entity brought malicious litigation; On the basis of analyzing the necessity of responding to the entity behavior of patent claims in China, the 4th part draws lessons from the relevant practices of the United States, and puts forward the relevant countermeasures for our country to deal with the substantive acts of patent claims.
