【摘要】：普通消費(fèi)者個(gè)人性的3D打印行為使得現(xiàn)行專利侵權(quán)制度受到前所未有的挑戰(zhàn),而國(guó)內(nèi)學(xué)界的應(yīng)對(duì)之說(shuō)莫衷一是。從專利質(zhì)量訴求的角度入手,根據(jù)利益平衡及權(quán)利限制原則,將專利侵權(quán)構(gòu)成要件之"為生產(chǎn)經(jīng)營(yíng)目的"改為"牟利目的",并恰當(dāng)適用"合理使用"規(guī)則,既可增強(qiáng)專利權(quán)保護(hù)以應(yīng)對(duì)3D打印技術(shù)下專利保護(hù)受到的沖擊,又可將專利保護(hù)限制在一個(gè)合理范圍,從而滿足公眾的正當(dāng)利益訴求,并有利于社會(huì)對(duì)優(yōu)質(zhì)專利之訴求的實(shí)現(xiàn)。
[Abstract]:The individual 3D printing behavior of ordinary consumers makes the current patent infringement system face unprecedented challenge, but the domestic academic circles have different opinions on how to deal with it. From the point of view of patent quality demand, according to the principle of balance of interests and rights limitation, Changing the constitutive elements of patent infringement from "for the purpose of production and operation" to "for the purpose of profit" and applying the rule of "reasonable use" properly can not only enhance the protection of patent right to cope with the impact of the protection of patent under 3D printing technology, The patent protection can be limited to a reasonable range, so as to meet the legitimate interests of the public, and conducive to the realization of the social demand for high-quality patents.
