【摘要】:美國學(xué)者查爾斯·弗里德(Charles Fried)曾說:“沒有隱私權(quán),人就失去了成其為人的重要要素!彪[私權(quán)對(duì)于個(gè)人具有重要意義。隱私權(quán)的價(jià)值不僅在于對(duì)個(gè)人生活、事務(wù)以及空間等權(quán)利免受打擾的保護(hù),更重要的是對(duì)個(gè)人信息及信息環(huán)境等權(quán)利的保護(hù)。在信息時(shí)代,尤其是在互聯(lián)網(wǎng)時(shí)代,隱私權(quán)的客體、內(nèi)涵與傳統(tǒng)環(huán)境下相比更容易受到侵害;ヂ(lián)網(wǎng)的快速發(fā)展在促進(jìn)社會(huì)、經(jīng)濟(jì)繁榮的同時(shí),也給人們隱私權(quán)利的保護(hù)帶來意想不到的困擾;ヂ(lián)網(wǎng)時(shí)代下信息的交流較之傳統(tǒng)時(shí)代變的更加頻繁、便捷,這一方面給人們的生活帶來了便利,另一方面也給人們信息隱私權(quán)利的保護(hù)增加了難度。網(wǎng)絡(luò)環(huán)境下侵犯信息隱私權(quán)利的現(xiàn)象與日俱增,給個(gè)人和社會(huì)帶來嚴(yán)重后果。而公眾人物作為網(wǎng)絡(luò)環(huán)境下的特殊群體,其隱私權(quán)利的保護(hù)備受關(guān)注。本文論述了網(wǎng)絡(luò)隱私權(quán)的含義及特點(diǎn)、公眾人物網(wǎng)絡(luò)環(huán)境下隱私權(quán)的定義、特征及特殊性,通過與歐盟、美國等國家公眾人物隱私權(quán)保護(hù)的比較,分析我國公眾人物隱私權(quán)的保護(hù)現(xiàn)狀,進(jìn)而對(duì)我國公眾人物隱私權(quán)的保護(hù)提出法律建議。隱私權(quán)是一項(xiàng)具體的人格權(quán)。隨著互聯(lián)網(wǎng)時(shí)代的到來,隱私權(quán)的保護(hù)范圍也隨之?dāng)U展至網(wǎng)絡(luò)生活安寧、個(gè)人信息安全、空間安寧等。個(gè)人隱私權(quán)在網(wǎng)絡(luò)環(huán)境下較之以往更易受到侵害,其中公眾人物隱私權(quán)尤為明顯。文中通過對(duì)比網(wǎng)絡(luò)環(huán)境與傳統(tǒng)環(huán)境下隱私權(quán)的內(nèi)涵,詳細(xì)闡述了公眾人物這一特殊群體在網(wǎng)絡(luò)環(huán)境下隱私權(quán)更易引發(fā)社會(huì)關(guān)注、更易影響公眾利益、更具商業(yè)價(jià)值等特征。同時(shí),通過研究域外公眾人物網(wǎng)絡(luò)環(huán)境下隱私權(quán)保護(hù)的發(fā)展模式,深入分析其模式發(fā)展成熟的要因。例如歐盟及其成員國通過立法措施,在保護(hù)最低隱私權(quán)保護(hù)基礎(chǔ)上,通過一系列法令明確隱私權(quán)保護(hù)的內(nèi)容,擴(kuò)大個(gè)人數(shù)據(jù)的保護(hù)范圍。另外筆者對(duì)其成員國德國頒布的系列法令進(jìn)一步深入研究,其將公眾人物區(qū)別對(duì)待、隱私范圍差別保護(hù)的細(xì)化措施對(duì)我國保護(hù)公眾人物隱私權(quán)具有重要的借鑒意義。美國雖采用行業(yè)自律模式來保護(hù)公民的隱私權(quán),但也未對(duì)隱私權(quán)的主體加以區(qū)分,而是通過一系列典型判例確定公眾人物隱私權(quán)保護(hù)的規(guī)則。美國立法保護(hù)不同之處在于更傾向于保護(hù)媒體的新聞自由,這也是有學(xué)者稱在美國公眾人物妄圖通過司法機(jī)關(guān)獲得保護(hù)機(jī)會(huì)渺茫的原因了。通過對(duì)域外公眾人物隱私權(quán)保護(hù)的立法規(guī)范、行業(yè)自律的學(xué)習(xí),筆者試圖找到適合我國隱私權(quán)保護(hù)的模式。目前我國關(guān)于隱私權(quán)制度發(fā)展存在的諸多問題,尤其是網(wǎng)絡(luò)環(huán)境下公眾人物隱私權(quán)保護(hù)在立法及行業(yè)自律方面的問題:我國對(duì)公眾人物隱私權(quán)立法不僅零散的分布于其他法律法規(guī)之中,而且立法位階較低,難以對(duì)其形成有效的保護(hù);在行業(yè)自律方面,雖然現(xiàn)狀互聯(lián)網(wǎng)行業(yè)規(guī)模較大,但行業(yè)起步較晚,尚未形成良好的行業(yè)秩序,往往難以自律。由此可見,無論在立法方面還是在行業(yè)自律方面,我國針對(duì)網(wǎng)絡(luò)環(huán)境下公眾人物隱私權(quán)的保護(hù)上都顯得捉襟見肘。通過對(duì)上述問題的深入研究,筆者對(duì)今后我國網(wǎng)絡(luò)環(huán)境下公眾人物隱私權(quán)的保護(hù)提出以下三點(diǎn)建議:首先,我國應(yīng)通過立法明確網(wǎng)絡(luò)環(huán)境下公眾人物隱私權(quán)的內(nèi)涵、界定公眾人物隱私權(quán)的范圍,借鑒域外國家立法保護(hù)的成果經(jīng)驗(yàn),同時(shí)結(jié)合我國具體國情,先設(shè)立基本法予以保護(hù),再完善案例指導(dǎo)制度,逐步加強(qiáng)對(duì)公眾人物隱私權(quán)的立法保護(hù);其次,政府部門應(yīng)發(fā)揮引導(dǎo)作用,逐步建立公眾官員信息分級(jí)披露制度,這不僅對(duì)公眾知情權(quán)負(fù)責(zé),也對(duì)當(dāng)前及今后的反腐工作具有積極意義;最后在國家法律法規(guī)的基礎(chǔ)上,互聯(lián)網(wǎng)行業(yè)應(yīng)制定內(nèi)部相應(yīng)的行業(yè)標(biāo)準(zhǔn),形成完整的行業(yè)自律框架,通過技術(shù)措施和政府監(jiān)督的雙重作用,促進(jìn)互聯(lián)網(wǎng)環(huán)境下公眾人物隱私權(quán)保護(hù)的良性發(fā)展。
[Abstract]:The American scholar Charles Fred (Charles Fried) said: "there is no privacy, people will lose the important elements of human." the right of privacy is important for personal privacy. The value lies not only in personal life, rights affairs and space protection against disturb, more important is the protection of personal information and the information environment rights. In the information age, especially in the Internet era, the connotation of the object of privacy, compared with the traditional environment more vulnerable. The rapid development of the Internet in promoting social and economic prosperity at the same time, also the protection of privacy rights for people to bring unexpected problems. The exchange of information in the Internet era compared with the traditional era becomes more and more frequent, convenient, which brings convenience to people's lives, protection on the other hand also give people information privacy rights more difficult. The phenomenon of violating the privacy rights of information grow with each passing day under network environment, with serious consequences for individuals and society. Public figures as a special group under the network environment, the protection of the rights of privacy concern. This paper discusses the meaning and characteristics of network privacy, right of privacy of public figures under the network environment network, characteristics and particularity by comparison, with the European Union, the United States and other countries to protect the privacy of public figures, analysis of the status quo of the protection of the privacy right of public figures in China, so as to protect the privacy of public figures in China put forward the legal suggestions. The privacy right is a specific personality. With the advent of the Internet era, the scope of protection of the right of privacy is also extended to the network of personal information security, peace, peace. Space of personal privacy in the network environment is more vulnerable to abuse, the privacy of public figures is particularly obvious. The right of privacy by comparing the network environment and traditional environment connotation in this paper, elaborated on this special group of public figures privacy in the network environment right more easily lead to social concerns, are more likely to influence the public interest, more commercial value feature. At the same time, the development model of privacy protection of the network domain Grandpa characters under the environment, in-depth analysis of its mode of development to mature. For example, the European Union and its member states through legislative measures in the protection of privacy protection on the basis of the lowest, through a series of decrees clear privacy protection content, expand the scope of protection. In addition, a data series of laws of its member states in Germany for further study the public figure, distinction, privacy protection measures range difference refinement is an important reference for our privacy protection of the public person. Although the United States by industry Law to protect the privacy of citizens, but also failed to distinguish the privacy of the subject, determine the protection of public figures privacy rules but through a series of typical cases. The legislation difference is more inclined to protect media freedom, this is also a study in the United States in an attempt by the judicial organs of public figures get the chance. The protection by legislation to protect the extraterritorial privacy of public figures, industry self-regulation learning, the author tries to find a suitable privacy protection mode in our country. At present there are many problems about the development of the system of the right to privacy, especially the problems in legislation and self-discipline aspects of the protection of the public person network privacy: China's public figures privacy legislation not only scattered in other laws and regulations, and the legislation level is low, it is difficult to form An effective protection; in industry self-regulation, although the status of the Internet industry in large scale, but the industry started late, has not yet formed a good trade order, it is often difficult to discipline. Therefore, whether in legislation or self-discipline in the industry of our country, in order to protect the privacy of the public person network environment have become stretched. Through research on the above problems, the protection of public figures in our country under the network environment, the privacy put forward the following three suggestions: first, China should legislate connotation of public physical privacy under the network environment, to define the scope of the right to privacy of public figures, from the legislative protection of foreign countries experience and achievements. Combined with China's specific national conditions, to set up the basic law to protect and improve case guidance system, and gradually strengthen the public figures privacy protection legislation; secondly, the government department The door should play a guiding role, and gradually establish a public official grading information disclosure system, which is not only responsible for the public's right to know, has a positive significance to the current and future anti-corruption work; finally, based on the laws of the country, the Internet industry should formulate corresponding standards within the industry, formed a complete framework of self-discipline, through double the role of technical measures and government supervision, and promote the healthy development of the protection of the public person under the environment of Internet privacy.
