【摘要】：《著作權法》自頒布以來,一直堅持的立場就是“時事新聞不適用于著作權法”,并且對于時事新聞的定義,法學界和新聞界也各有自己的觀點,這樣不利于著作權法發(fā)揮其應有的作用,更不利于新聞業(yè)的發(fā)展和進步。本文試圖對時事新聞再定義,并以此為基礎提出對時事新聞著作權保護的修改意見,希望對我國著作權法的完善有所幫助。除引言外,正文共分五大部分,結構如下：第一章探討我國時事新聞著作權保護的現(xiàn)狀及存在的問題。從我國時事新聞著作權保護的立法現(xiàn)狀、司法實踐出發(fā),闡述我國時事新聞存在定義不符合新聞實踐、時事新聞著作權保護的相關規(guī)定存在矛盾等問題。第二章對時事新聞概念再定義。通過解讀法學界、新聞界對該概念的理解,對時事新聞進行重新定義。第三章探討再定義時事新聞著作權保護的正當性。通過探討著作權法保護作品的正當性,分析著作權不保護時事新聞的原因,發(fā)現(xiàn)絕大多數時事新聞符合作品的構成要件,同時在新形勢下時事新聞也是有保護需要的。第四章探討時事新聞相關法律規(guī)定的國外經驗借鑒。通過了解國際公約及國外著作權法的規(guī)定來談談對我國的啟示意義。第五章探討時事新聞著作權法律保護條款的修改意見。提出了刪除規(guī)定型和完善健全型兩種意見,并進行比較與選擇。
[Abstract]:Since its promulgation, the copyright Law has maintained the position that "current affairs news does not apply to the copyright law," and the legal circles and the press have their own views on the definition of current affairs news. This is not conducive to the copyright law to play its due role, but also to the development and progress of the news industry. This paper attempts to redefine current affairs news, and based on this, puts forward some suggestions for revising the copyright protection of current affairs news. I hope it will be helpful to the improvement of our copyright law. Besides the introduction, the text is divided into five parts. The structure is as follows: the first chapter discusses the current situation and existing problems of the copyright protection of current affairs news in our country. Based on the legislative situation and judicial practice of the copyright protection of current affairs news in our country, the author expounds that the definition of the existence of current affairs news in our country does not accord with the news practice. The second chapter redefines the concept of current affairs news. Through the interpretation of the legal circles, the press understands the concept. Redefine current affairs news. Chapter three discusses the legitimacy of redefining the copyright protection of current affairs news. By discussing the legitimacy of copyright law to protect works, we analyze the reasons why copyright does not protect current affairs news. It was found that most of the current affairs news corresponded to the elements of the work. At the same time, current affairs news also needs to be protected under the new situation. Chapter 4th discusses the foreign experience of current affairs news related laws and regulations. Through understanding the international conventions and the provisions of foreign copyright law to talk about the enlightenment to our country. Chapter 5th discusses the amendments to the articles on the legal Protection of copyright in current events News. It puts forward two opinions: deleting the prescribed type and perfecting the perfect one. And compare and choose.
