【摘要】：對(duì)社會(huì)關(guān)注度較高的石家莊雙環(huán)汽車股份有限公司與本田技研工業(yè)株式會(huì)社專利糾紛案進(jìn)行全面梳理與分析,就合理維權(quán)與不正當(dāng)競(jìng)爭(zhēng)行為的界限、《反不正當(dāng)競(jìng)爭(zhēng)法》第2條的適用等問題進(jìn)行探討,并針對(duì)此案提出相關(guān)建議。
[Abstract]:The patent disputes between Shijiazhuang Shuanghuan Automobile Co., Ltd. and Honda Technology Research Industry Co., Ltd., which have a high degree of social concern, are comprehensively combed out and analyzed. This paper discusses the limits of reasonable rights protection and unfair competition behavior, and the application of Article 2 of the Anti-unfair Competition Law, and puts forward some relevant suggestions for this case.
