【摘要】：依據(jù)我國《著作權(quán)法》,整理已有作品而產(chǎn)生的作品,其著作權(quán)由整理人享有。有的法院認(rèn)為,古籍整理成果凝聚了整理人員的創(chuàng)造性勞動,享有著作權(quán)保護(hù);而有的法院則認(rèn)為,古籍整理成果不能作為作品受到著作權(quán)法保護(hù)。古籍整理的目的在于還原古籍原意,整理人不是作者,整理成果未產(chǎn)生新作品,不應(yīng)享有作者權(quán)保護(hù)。但為使古籍整理成果的利益得到必要的維護(hù),《著作權(quán)法》可在鄰接權(quán)框架下為古籍整理者增設(shè)一項新權(quán)利——古籍整理者權(quán)。
[Abstract]:According to the copyright Law of our country, the copyright of the works produced by the collation of the existing works is enjoyed by the collators. Some courts hold that the achievements of the collation of ancient books condense the creative work of the collators and enjoy the protection of the copyright; Some courts, however, have held that the achievements of the collation of ancient books cannot be protected as works by copyright law. The purpose of the arrangement of ancient books is to restore the original intention of the ancient books, that the author is not the author, and that the results of the collation have not produced new works. The author's right should not be protected, but in order to protect the interests of the ancient book collation achievements, the copyright Law can add a new right for the ancient book collator under the frame of neighboring right, that is, the ancient book sorting person's right.
