【摘要】：成年監(jiān)護(hù)制度設(shè)立的目的在于保護(hù)成年精神障礙者的人身、財(cái)產(chǎn)和其他合法的權(quán)益。此制度通過彌補(bǔ)障礙者行為能力,使其民事權(quán)利得到充分實(shí)現(xiàn)。成年監(jiān)護(hù)制度所具有的制度價(jià)值使其受到各國(guó)的重視。目前,德、日、法、美等主要大陸法系國(guó)家制定了比較完善的成年監(jiān)護(hù)制度。但我國(guó)成年監(jiān)護(hù)制度發(fā)展較晚,立法貧瘠、且不便于操作。隨著社會(huì)老齡化加劇和精神病人口增加,原有的成年監(jiān)護(hù)制度已經(jīng)無(wú)法滿足社會(huì)需求,難以發(fā)揮其制度的真正作用。本文在結(jié)合外國(guó)成功立法經(jīng)驗(yàn)和我國(guó)實(shí)際情況的基礎(chǔ)上上,對(duì)我國(guó)成年監(jiān)護(hù)制度改革提出完善建議。
