【摘要】：每個(gè)社會(huì)成員都平等地享有人格權(quán),隱私權(quán)作為人格權(quán)的一部分,對(duì)于每個(gè)社會(huì)成員而言,也是其平等享有的權(quán)利。從個(gè)人角度而言,尊重他人隱私,是個(gè)人素質(zhì)和修養(yǎng)的體現(xiàn)；從社會(huì)角度而言,尊重公民隱私,是社會(huì)進(jìn)步和高度文明的體現(xiàn)。隱私權(quán)作為一項(xiàng)保障個(gè)人生活空問(wèn)不受任意侵?jǐn)_的法定權(quán)利,在追求個(gè)人人格獨(dú)立自主的現(xiàn)今社會(huì)顯得尤為重要。但是由于傳統(tǒng)觀念的影響,家庭領(lǐng)域內(nèi)的隱私權(quán),特別是配偶及未成年子女的隱私權(quán)長(zhǎng)期得不到人們的重視,其隱私權(quán)保護(hù)更是非常薄弱,很多不良后果已經(jīng)開(kāi)始逐步顯現(xiàn)。對(duì)家庭成員隱私權(quán)進(jìn)行保護(hù)又往往會(huì)面臨與其他權(quán)利發(fā)生沖突的問(wèn)題,只有厘清沖突的表現(xiàn)及根源才能對(duì)癥下藥對(duì)家庭成員的隱私權(quán)進(jìn)行更好的保護(hù)。本文著眼于家庭領(lǐng)域內(nèi)配偶及未成年子女的隱私權(quán),對(duì)其權(quán)利行使過(guò)程中可能發(fā)生的權(quán)利沖突及法律保護(hù)進(jìn)行探討。文章第一部分首先對(duì)家庭成員隱私權(quán)的相關(guān)概念進(jìn)行解析,重點(diǎn)剖析隱私及隱私權(quán)的定義,進(jìn)而對(duì)家族成員隱私權(quán)進(jìn)行界定。只有對(duì)上述概念有明確清晰的認(rèn)識(shí),才能更好地對(duì)其保護(hù)現(xiàn)狀作進(jìn)一步分析探討。文章的第二部分分析了國(guó)內(nèi)外家庭成員隱私權(quán)保護(hù)的現(xiàn)狀,并對(duì)我國(guó)民法通則、相關(guān)司法解釋、相關(guān)單行法中涉及家庭成員隱私權(quán)的內(nèi)容進(jìn)行分析,借以發(fā)現(xiàn)我國(guó)在這一問(wèn)題上存在的法律漏洞。文章的第三部分承接上一部分的內(nèi)容,指出我國(guó)在配偶及未成年人隱私權(quán)保護(hù)方面存在的缺陷,配偶及未成年人隱私權(quán)與配偶知情權(quán)、父母監(jiān)護(hù)權(quán)沖突的表現(xiàn)及原因。因?yàn)閷?duì)家庭成員隱私權(quán)進(jìn)行保護(hù)面臨最主要的問(wèn)題就是權(quán)利沖突的問(wèn)題,筆者在這部分對(duì)沖突的表現(xiàn)及原因進(jìn)行剖析,唯有如此才能發(fā)現(xiàn)在權(quán)利的沖突過(guò)程中我國(guó)法律對(duì)隱私權(quán)的保護(hù)存在哪些不足。文章的最后一部分筆者提出了對(duì)保護(hù)家庭領(lǐng)域內(nèi)配偶及未成年人隱私權(quán)的完善建議。在充分注意配偶及未成年人隱私權(quán)特殊性的基礎(chǔ)之上,逐一解決在剖析權(quán)利沖突過(guò)程中發(fā)現(xiàn)的問(wèn)題,對(duì)完善未成年子女隱私權(quán)的保障體系及配偶隱私權(quán)的保障體系進(jìn)行詳細(xì)建議。
[Abstract]:Every member of the society enjoys the right of personality equally, the right of privacy as a part of the right of personality, for every member of the society, it is also an equal right to enjoy. From the personal point of view, respect for the privacy of others. It is the embodiment of personal quality and accomplishment; From the social point of view, respect for the privacy of citizens is the embodiment of social progress and a high degree of civilization. In the pursuit of individual personality independence in today's society is particularly important, but due to the impact of traditional concepts, the privacy of the family field. Especially the spouse and minor children of privacy has not been paid attention to for a long time, its privacy protection is very weak. Many adverse consequences have begun to appear gradually. The protection of the right to privacy of family members often faces the problem of conflict with other rights. Only by clarifying the manifestations and root causes of the conflict can the right to privacy of family members be better protected. This article focuses on the privacy rights of spouses and minor children in the family field. The first part of the article analyzes the related concepts of the privacy of family members, focusing on the definition of privacy and privacy. Then define the privacy of family members. Only have a clear understanding of the above concept. The second part of the article analyzes the status quo of the protection of the privacy of family members at home and abroad, and the general principles of civil law, relevant judicial interpretation. In order to find the legal loophole in our country, the third part of the article carries on the content of the last part of the article, which is related to the content of the family members' privacy right in the relevant special law to carry on the analysis in order to find the legal loophole in our country. The author points out the defects in the protection of the right to privacy of spouses and minors in China, the right to privacy of spouses and minors and the right of spouses to know. Because the most important problem of the protection of the right to privacy of family members is the issue of conflict of rights, the author analyzes the performance and reasons of the conflict in this part. Only in this way can we find out what deficiencies exist in the protection of the right of privacy in the course of the conflict of rights. In the last part of the article, the author puts forward the perfection of the protection of the right of privacy of spouses and minors in the field of family. On the basis of paying full attention to the particularity of the right to privacy of spouses and minors. To solve the problems found in the process of analyzing the conflict of rights one by one, to perfect the protection system of minor children's right to privacy and spouse privacy system to carry on the detailed proposal.
