第三人致提供勞務(wù)者受害案件責(zé)任承擔(dān)初探

【摘要】:《中華人民共和國侵權(quán)責(zé)任法》自2010年起正式實(shí)施,相應(yīng)的《民事案由規(guī)定》也將提供勞務(wù)者受害責(zé)任糾紛替代雇員受害責(zé)任糾紛。由于沒有出臺(tái)《侵權(quán)責(zé)任法》司法解釋,且其規(guī)定與《最高人民法院關(guān)于審理人身損害賠償案件適用法律若干問題的解釋》的規(guī)定不一致甚至沖突,導(dǎo)致在司法實(shí)踐中大量個(gè)人勞務(wù)糾紛,特別是第三人致害的復(fù)雜案件難以得到統(tǒng)一的法律解讀及責(zé)任認(rèn)定。本文通過幾則典型的第三人致提供勞務(wù)者受害案件的司法案例,提出研究主題——接受勞務(wù)者和第三人的責(zé)任承擔(dān)問題。全文分為四部分:第一部分是問題的提出,指出在現(xiàn)行法律的規(guī)定下,該類案件審判實(shí)踐中主要存在責(zé)任認(rèn)定方面的問題,有仍沿用舊法適用無過錯(cuò)責(zé)任原則、片面理解新法過錯(cuò)原則只考慮提供勞務(wù)者單方過錯(cuò)以及擴(kuò)大適用雇員選擇權(quán)、雇主追償權(quán)等情形。第二部分概述確定該類案件責(zé)任的前提條件,從法律關(guān)系上來說,該類案件的受案范圍應(yīng)屬于有償?shù)膫(gè)人勞務(wù)關(guān)系,雇傭關(guān)系作為勞務(wù)關(guān)系的上位概念其區(qū)分及認(rèn)定不是案件審理的重點(diǎn);從事實(shí)的認(rèn)定上來說,提供勞務(wù)者受害事實(shí)需要同時(shí)具備時(shí)間、空間及因果關(guān)聯(lián)性三要素。第三部分是本文的主要部分,著重討論責(zé)任承擔(dān)問題,從理論基礎(chǔ)、歸責(zé)原則到責(zé)任分配三方面確定接受勞務(wù)者與第三人之間應(yīng)以過錯(cuò)責(zé)任為原則相互獨(dú)立地各自承擔(dān)相應(yīng)責(zé)任;第四部分是本文的結(jié)論,筆者在以上理論基礎(chǔ)上進(jìn)一步擬出的司法解釋建議稿。全文嘗試重新解讀第三人致提供勞務(wù)者受害案件,明確接受勞務(wù)者與第三人相互獨(dú)立的責(zé)任關(guān)系,希望文章能夠?yàn)樵擃惏讣牧⒎ń忉、司法指?dǎo)作出可資參照的淺見。
[Abstract]:The Law of the people's Republic of China on Tort liability has been in force since 2010. The corresponding provisions on Civil cases will also replace the disputes over the victimization liability of employees by the disputes on the victimization liability of the providers of labor services, as there is no judicial interpretation of the Tort liability Law. And its provisions and the Supreme people's Court on the trial of personal injury compensation cases applicable to the interpretation of a number of legal issues inconsistent or even conflicting, resulting in a large number of personal labor disputes in judicial practice. Especially the complex cases caused by the third party are difficult to get a unified legal interpretation and responsibility. The thesis is divided into four parts: the first part is the raising of the problem, pointing out the provisions of the current law. This kind of case trial practice mainly exists the responsibility confirmation aspect question, some still uses the old law to apply the principle of no-fault liability. The one-sided understanding of the new law fault principle only considers the unilateral fault of the provider and the extension of the application of the employee's option, the employer's right of recourse. The second part outlines the preconditions for determining the liability of this kind of cases. In terms of legal relations, the scope of accepting cases should belong to paid personal labor relations. As the upper concept of labor relations, the distinction and determination of employment relations is not the focus of the trial. From the point of view of the facts, the victim facts of labor providers need to have three elements of time, space and causality at the same time. The third part is the main part of this paper, focusing on the issue of responsibility, from the theoretical basis. From the principle of liability to the distribution of responsibility, it is determined that the fault liability should be taken as the principle between the recipient and the third party to bear the corresponding responsibility independently. Part 4th is the conclusion of this paper, the author based on the above theoretical basis of further judicial interpretation of the proposed draft. The full text attempts to reinterpret the third party to the victim of labor cases. It is hoped that the article can provide a reference for the legislative interpretation and judicial guidance of this kind of cases.
