【摘要】：少數(shù)民族民間文學(xué)藝術(shù)是民族寶貴的文化資源,但是關(guān)于相關(guān)資源的開發(fā)利用并沒有形成有效規(guī)范,影響了資源保護(hù),也影響了民族民眾正當(dāng)利益的獲得,因此,應(yīng)結(jié)合當(dāng)前民族民間文學(xué)藝術(shù)開發(fā)利用中的法律爭議,在相關(guān)資源的權(quán)利主體、所有權(quán)益、相關(guān)法律人、權(quán)利限制等方面進(jìn)行法律規(guī)范。另外,相關(guān)法律方面的規(guī)范還必須遵從一定的原則,只有這樣,民族民間文學(xué)藝術(shù)的法律規(guī)范才能合情合理地建構(gòu)起有序的法律空間。
[Abstract]:Ethnic folk literature and art is a valuable national cultural resources, but the development and utilization of related resources has not formed an effective norm, which has affected the protection of resources, but also affected the legitimate interests of the national people. Therefore, we should combine the current legal disputes in the development and utilization of national folklore and art, in the relevant resources of the subject of rights, all rights and interests, relevant legal person, rights restrictions and other aspects of legal norms. Only in this way, the legal norms of national folklore and art can reasonably construct an orderly legal space.
