【摘要】：云計(jì)算在快速發(fā)展的同時也產(chǎn)生了一系列的著作權(quán)侵權(quán)糾紛案件,新技術(shù)的發(fā)展總是伴隨著些許爭議,而我國目前的《著作權(quán)法》仍屬于比較傳統(tǒng)的法律體系,為適應(yīng)網(wǎng)絡(luò)的迅速發(fā)展而頒發(fā)的《信息網(wǎng)絡(luò)傳播權(quán)保護(hù)條例》以及司法解釋中也無法適應(yīng)不斷興起的新技術(shù)。本文期在傳統(tǒng)版權(quán)體系的基礎(chǔ)上,結(jié)合信息網(wǎng)絡(luò)傳播權(quán)立法的歷史沿革以及現(xiàn)行有效的法律法規(guī),運(yùn)用歷史研究、規(guī)范分析與案例分析法淺談云技術(shù)的發(fā)展對信息網(wǎng)絡(luò)傳播權(quán)帶來的影響,從而試圖探索如何兼顧版權(quán)人與技術(shù)創(chuàng)新之間的利益,從而達(dá)到一種共享雙贏的狀態(tài)。云計(jì)算技術(shù)的特征決定了在涉及云計(jì)算侵權(quán)的判斷時不能采取傳統(tǒng)的判斷路徑,必須在信息網(wǎng)絡(luò)傳播行為構(gòu)成要件的基礎(chǔ)上,結(jié)合侵權(quán)人具體的傳播方式與技術(shù)手段探其實(shí)質(zhì)。筆者將根據(jù)國際公約的立法歷史以及我國《著作權(quán)法》2001年新增信息網(wǎng)絡(luò)傳播權(quán)以來的司法發(fā)展并結(jié)合司法解釋總結(jié)出信息網(wǎng)絡(luò)傳播行為的構(gòu)成要件,并進(jìn)一步細(xì)化,從而討論這種新特征給信息網(wǎng)絡(luò)傳播權(quán)侵權(quán)判斷造成的影響,如云計(jì)算的運(yùn)營模式下不同云計(jì)算服務(wù)商的侵權(quán)責(zé)任。并通過案例比較論證云計(jì)算服務(wù)確實(shí)導(dǎo)致了司法判決結(jié)果的不一致。本文最后筆者主要討論了當(dāng)前云計(jì)算技術(shù)使用比較活躍的信息網(wǎng)絡(luò)行為,如云視頻。該部分主要以武漢中級人民法院2011年受理的當(dāng)時轟動一時的首起涉云視頻的著作權(quán)糾紛案為切入點(diǎn),討論云視頻領(lǐng)域涉及侵權(quán)時應(yīng)根據(jù)它們的技術(shù)特征、傳播方式以及商業(yè)模式綜合分析其侵權(quán)屬性。
[Abstract]:Cloud computing in the rapid development of a series of copyright infringement disputes, the development of new technology is always accompanied by a bit of controversy, and the current "copyright Law" is still a more traditional legal system. In order to adapt to the rapid development of the network, "Information Network Communication right Protection regulations" and judicial interpretation can not adapt to the rising new technology. This paper is based on the traditional copyright system. Combined with the history of information network communication right legislation and the current effective laws and regulations, the use of historical research, normative analysis and case analysis of cloud technology on the impact of information network communication rights. In order to explore how to balance the interests of copyright owners and technological innovation. The characteristics of cloud computing technology determine that the traditional judgment path can not be taken when it comes to the judgment of cloud computing infringement, and must be based on the constitutive elements of information network communication behavior. According to the legislative history of the international convention and the judicial development of the new right of information dissemination in 2001, the author will explore its essence by combining the specific communication methods and technical means of the infringer. Judicial interpretation summarizes the elements of information network communication behavior. And further refinement, so as to discuss the new characteristics of the information network communication right infringement judgment caused by the impact. For example, under the operation mode of cloud computing, the tort liability of different cloud computing service providers is proved by case comparison. Finally, the author mainly discusses the current cloud computing. The technology uses more active information network behavior. This part is mainly based on Wuhan Intermediate people's Court in 2011 to accept the first hit at that time cloud video copyright dispute as a breakthrough point. When discussing the infringement in cloud video domain, we should analyze the tort property according to their technical characteristics, transmission mode and business model.
