【摘要】：中共中央、國(guó)務(wù)院《關(guān)于完善產(chǎn)權(quán)保護(hù)制度依法保護(hù)產(chǎn)權(quán)的意見》專門就加大知識(shí)產(chǎn)權(quán)保護(hù)力度提出了方法、路徑和要求。國(guó)務(wù)院辦公廳印發(fā)知識(shí)產(chǎn)權(quán)綜合管理改革試點(diǎn)總體方案,探索建立高效的知識(shí)產(chǎn)權(quán)綜合管理體制。黨的十八屆四中全會(huì)提出了行政檢察的改革命題,即"檢察機(jī)關(guān)在履行職責(zé)中發(fā)現(xiàn)行政機(jī)關(guān)違法行使職權(quán)或者不行使職權(quán)的行為,應(yīng)該督促其糾正"。在深化改革和鼓勵(lì)創(chuàng)新的時(shí)代背景下,回顧和考量知識(shí)產(chǎn)權(quán)行政檢察的歷史和實(shí)踐,研究和探索知識(shí)產(chǎn)權(quán)行政檢察的基本理念和重要途徑,有助于推動(dòng)形成知識(shí)產(chǎn)權(quán)保護(hù)的大格局。
[Abstract]:The opinions of the CPC Central Committee and the State Council on perfecting the system of property right Protection in accordance with the Law specifically put forward methods for strengthening the protection of intellectual property rights. Path and requirements. The General Office of the State Council has issued a pilot overall plan for the comprehensive management reform of intellectual property rights. The fourth Plenary session of the 18 CPC Central Committee put forward the proposition of administrative procuratorial reform. That is, "procuratorial organs in the performance of their duties found that the administrative organs illegally exercise their functions and powers, or do not exercise their functions and powers, should be urged to correct"... in the context of deepening reform and encouraging innovation in the background of the times. Reviewing and considering the history and practice of intellectual property administrative procuratorial, studying and exploring the basic idea and important ways of intellectual property administrative procuratorial work will help to promote the formation of a large pattern of intellectual property protection.
