【摘要】：新增規(guī)避3D打印機給料限制技術(shù)措施的臨時例外是美國DMCA試圖激勵3D打印領(lǐng)域的技術(shù)創(chuàng)新、平衡3D打印企業(yè)與消費者之間利益的一種立法嘗試。文章分析各利益方圍繞非侵權(quán)性使用、不利影響和法定因素展開的博弈,解讀該條款的假定、行為模式、法律后果。規(guī)避3D打印機給料限制技術(shù)措施的行為不被認定為版權(quán)法上的侵權(quán)應(yīng)同時滿足:以使用替代材料進行3D打印為實施規(guī)避行為的唯一目的;不實施任何旨在獲取存儲于3D打印機中的其他專有數(shù)據(jù)的行為;不以具備打印商業(yè)產(chǎn)品或材料能力的3D打印機給料限制技術(shù)措施為規(guī)避行為的實施對象等條件。我國可考慮增加對規(guī)避3D打印給料限制技術(shù)措施行為的豁免規(guī)定、加強對3D設(shè)計文件的版權(quán)監(jiān)管及簽發(fā)"版權(quán)申明標志"。
[Abstract]:The new temporary exception to the technical measures to circumvent the feeding restrictions of 3D printers is the attempt by the United States DMCA to stimulate technological innovation in the field of 3D printing. A legislative attempt to balance the interests of 3D printing enterprises and consumers. This paper analyzes the game of non-infringing use, adverse effects and legal factors, and interprets the assumptions and behavior patterns of this clause. Legal consequences. The act of circumventing the technical measures of restricting the supply of 3D printer should not be considered as infringement of copyright law: the only purpose of the circumvention is to use the substitute material for 3D printing; Does not perform any act aimed at obtaining other proprietary data stored in a 3D printer; It is not necessary to take the technical measures of 3D printer feeding which have the ability to print commercial products or materials as the object of circumvention. Our country may consider increasing the exemption of the technical measures to circumvent the 3D printing feed restrictions. The rules. Strengthen the copyright control of 3D design documents and issue "copyright declaration logo".
