【摘要】:創(chuàng)新型的第三方支付發(fā)展成功變革了人們的支付習(xí)慣。以互聯(lián)網(wǎng)技術(shù)為依托的新型支付手段在給人們帶來便利的同時,也造成了前所未有的支付安全隱患。支付機構(gòu)與消費者之間信息不對稱,導(dǎo)致了二者權(quán)利義務(wù)的嚴(yán)重失衡。消費者的財產(chǎn)安全與信息安全在這樣的支付環(huán)境下面臨新的風(fēng)險與危機。受法律滯后性的影響,國內(nèi)第三方支付業(yè)一度處于監(jiān)管空白階段。2010年中國人民銀行《非金融機構(gòu)支付服務(wù)管理辦法》及其實施細(xì)則的出臺標(biāo)志著第三方支付業(yè)開始步入法律監(jiān)管時代。但盡管之后陸續(xù)制定了一系列相關(guān)的規(guī)范性文件,可依舊缺乏保護消費者安全權(quán)的針對性法律規(guī)范。而消費者權(quán)益保護法的內(nèi)容適用性不高,新的行為規(guī)范又出現(xiàn)缺位。第三方支付消費者一面遭遇支付機構(gòu)利用格式合同等手段轉(zhuǎn)嫁風(fēng)險,一面又處于"救濟難""舉證難"的尷尬之境。文章旨在通過梳理中外第三方支付監(jiān)管立法,研究分析第三方支付的運行模式,尋找出國內(nèi)法律監(jiān)管的漏洞與問題,最終從現(xiàn)實性與立法性兩個方向為完善消費者安全權(quán)制度提出些許建議,以期進一步明確支付機構(gòu)的職責(zé)義務(wù),改善消費者的弱勢地位,提高支付機構(gòu)的自律守法意識以及消費者的維權(quán)意識,為促進我國第三方支付的良性發(fā)展做出努力。全文以維護第三方支付消費者的財產(chǎn)安全、信息安全為主題內(nèi)容展開研究,共由四個章節(jié)構(gòu)成。第一章就第三方支付與消費者安全權(quán)的基本內(nèi)涵作基本闡述。主要介紹了消費者財產(chǎn)安全權(quán)與信息安全權(quán)的界定,并從經(jīng)濟法學(xué)的角度肯定消費者安全權(quán)問題受經(jīng)濟法規(guī)制的正當(dāng)性與必要性,為后文分析具體風(fēng)險與問題打好基礎(chǔ)。第二章基于第一章的內(nèi)容,從立法與現(xiàn)實兩個角度,就第三方支付中的消費者安全權(quán)受損的現(xiàn)狀問題展開深入分析。第三章主要以前一章為行文依據(jù),企圖以參考借鑒的眼光搜集整理國內(nèi)外的立法監(jiān)管實踐,以期為解決我國保護第三方支付中消費者安全權(quán)的問題與困境提供思路。因而該章主要從財產(chǎn)安全與信息安全入手,介紹了國內(nèi)外劃分未授權(quán)責(zé)任、處理沉淀資金以及信息披露、隱私權(quán)保護等方面的立法經(jīng)驗與實踐創(chuàng)新。第四章在參考第三章的內(nèi)容后,綜合提出了健全消費者安全權(quán)法律監(jiān)管體系與完善格式條款監(jiān)管制度、信息披露制度等涵蓋實踐與立法的建議。
[Abstract]:The successful development of innovative third-party payment has changed people's payment habits. The new payment means based on Internet technology bring convenience to people. It also causes unprecedented security risks of payment. The information between payment agencies and consumers is asymmetric. It leads to the serious imbalance between the rights and obligations of the two. Consumers' property security and information security are faced with new risks and crises under such payment environment, which is influenced by the lag of law. In 2010, the people's Bank of China (PBOC) and its detailed rules for the implementation of the third party payment industry began to enter the legal supervision. But after that, a series of related normative documents have been developed one after another. However, there is still a lack of targeted legal norms to protect consumers' right to safety. However, the content of consumer rights and interests protection law is not highly applicable. The new code of conduct is also absent. Third party payment consumers face the risk of passing on the risk by means of format contract and other means. On the one hand, it is in the awkward state of "relief difficult" and "hard to prove". This article aims at studying and analyzing the operation mode of third-party payment by combing the third party payment supervision legislation at home and abroad. Find out the loopholes and problems of domestic legal supervision, and finally from the reality and legislative two directions to improve consumer safety rights system to put forward some suggestions, in order to further clarify the duties and obligations of payment agencies. Improve the weak position of consumers, enhance the self-discipline and law-abiding awareness of payment agencies and consumers' awareness of safeguarding their rights. In order to promote the benign development of third-party payment in China, this paper focuses on the maintenance of third-party payment consumer property security, information security as the theme of the study. It consists of four chapters. The first chapter describes the basic connotation of third-party payment and consumer security right. It mainly introduces the definition of consumer property security right and information security right. And from the perspective of economic law to affirm the legitimacy and necessity of consumer safety rights subject to economic laws and regulations for the following analysis of specific risks and problems. Chapter two is based on the content of the first chapter. From the perspective of legislation and reality, this paper deeply analyzes the current situation of the loss of consumers' right to safety in third-party payment. The third chapter is mainly based on the previous chapter. The author tries to collect and sort out the domestic and foreign legislative supervision practice with reference and reference. In order to solve the problems and dilemmas in the protection of consumer security rights in third-party payment in China, this chapter mainly starts with property security and information security, and introduces the division of unauthorized responsibility at home and abroad. The legislative experience and practice innovation in dealing with precipitated funds and information disclosure, privacy protection, etc. Chapter 4th, after referring to the contents of Chapter 3. Some suggestions are put forward such as perfecting the legal supervision system of consumers' right to safety, perfecting the supervision system of standard clauses, and information disclosure system covering practice and legislation.
