【摘要】："無(wú)錫冷凍胚胎案"嚴(yán)格遵循法律適用規(guī)則,成為中國(guó)十年來(lái)少見(jiàn)的好判決。而法律適用就是"找法"的過(guò)程。首先,現(xiàn)行法律沒(méi)有明確規(guī)定冷凍胚胎的法律屬性,法院需對(duì)其進(jìn)行法律解釋。冷凍胚胎兼具物的實(shí)體性及人的人格性,因此無(wú)論如何法律均應(yīng)給予其充分保護(hù)。其次,在目前立法空白的情形下,法院可依"法理"進(jìn)行創(chuàng)制性地補(bǔ)充,將本案爭(zhēng)議歸納為對(duì)胚胎的監(jiān)管和處置權(quán)。最后,結(jié)合"事理"與"法理",兼顧冷凍胚胎與雙方老人間情感上的密切聯(lián)系與"法無(wú)禁止皆可為"、公序良俗等基本原則,進(jìn)一步論證胚胎權(quán)屬分配的合法性與合理性。
[Abstract]:The case of frozen embryos in Wuxi strictly follows the applicable rules of the law and has become a good judgment rarely seen in China for ten years. And the application of the law is the process of "looking for the law". First of all. The current law does not clearly specify the legal attributes of frozen embryos, which need to be interpreted by the court. The entity of frozen embryos and the personality of human beings. Therefore, in any case, the law should give it adequate protection. Secondly, in the current legislative gaps, the court can be in accordance with the "doctrine of law" to creatively supplement. The dispute in this case is summarized as the right to supervise and dispose of embryos. Finally, combined with "principle" and "legal theory", the close emotional relationship between frozen embryos and the elderly of both sides can be taken into account. The basic principles of public order and good custom further demonstrate the legitimacy and rationality of embryo ownership distribution.
