【摘要】：僧侶遺產(chǎn)歸屬的爭議屢有發(fā)生,尚未取得共識(shí)。隨著經(jīng)濟(jì)、社會(huì)的發(fā)展,僧尼逐漸擁有私有財(cái)產(chǎn),形成出家前所享有財(cái)產(chǎn)等可能的類型。從僧侶遺產(chǎn)處置的歷史沿革來看,逐漸從不承認(rèn)其私人所有性質(zhì)從而加以剝奪向有限承認(rèn)其意愿從而以遺贈(zèng)、遺贈(zèng)撫養(yǎng)協(xié)議乃至世俗親屬繼承的方式轉(zhuǎn)變。僧侶遺產(chǎn)問題不是繼承權(quán)問題,并不適用繼承法上的遺囑、遺贈(zèng)等制度。僧侶出家時(shí)通過離婚、取得父母親書面同意等要件脫離世俗家庭的權(quán)利義務(wù)關(guān)系,與寺院訂立死因贈(zèng)與契約,在僧侶死亡時(shí),就僧侶遺產(chǎn)范圍內(nèi)贈(zèng)與之債應(yīng)當(dāng)優(yōu)先受償。僧侶遺產(chǎn)問題中,有規(guī)約的,應(yīng)當(dāng)首先按數(shù)方當(dāng)事人達(dá)成一致的規(guī)約處理,僧侶共同體作為享有免稅待遇的非營利組織,不可就該死因贈(zèng)與契約的權(quán)利義務(wù)內(nèi)容進(jìn)行變更,不可放棄自身對于契約中約定死亡時(shí)遺產(chǎn)轉(zhuǎn)移的取得權(quán)。
[Abstract]:There have been many disputes over the ascription of monks, and there has been no consensus. With the development of economy and society, and has gradually formed the private property, before becoming a monk enjoys property and other possible types. From the perspective of the historical evolution of monastic heritage disposal, it has gradually denied the private property of the monarch, and has been deprived of its limited will to transform it in the way of legacy, bequest maintenance agreement and even the common people's inheritance. The problem of monks' heritage is not the right of inheritance, and it does not apply to the system of the will and bequest in the inheritance law. When the monks came out, they divorced from the parents and got the written consent from parents. They were divorced from the rights and obligations of the secular families, and entered into a contract for the death cause and the temple. When the monks died, the donation obligation within the monastic heritage should be compensated first. The monks heritage, a statute, the statute should be the first treatment according to the number of parties to reach agreement, monks community as a non-profit organization to enjoy duty-free treatment, can not change the rights and obligations of the contract should cause the gift, do not give up their own right for the death of agreed estate transfer contract.
