【摘要】：《女職工勞動保護(hù)規(guī)定》自1988年頒布以來,在婦女權(quán)益保護(hù)和女職工勞動保護(hù)方面發(fā)揮了重要作用。但是,在中國社會轉(zhuǎn)型期和全球化的背景下,原有《規(guī)定》中確立的原則和適用性受到挑戰(zhàn),這就為進(jìn)一步修訂提出了要求。為了反映這一要求,《女職工勞動保護(hù)條例》(修訂草案)經(jīng)過反復(fù)討論,在其適用范圍、女職工勞動保護(hù)標(biāo)準(zhǔn)、生育保險(xiǎn)待遇、女職工勞動合同、法律責(zé)任等方面做出了重要修改,在進(jìn)一步保障女職工平等的就業(yè)權(quán)利、生育保障權(quán)利、健康權(quán)利和法律權(quán)利等方面提出了建設(shè)性意見。在《條例》修訂草案討論和征求意見之際,進(jìn)一步對《條例》修改的原則、修改的依據(jù)、適用范圍、保護(hù)程度、生育保護(hù)、以及其他應(yīng)增加的內(nèi)容等進(jìn)行討論,具有非常重要的意義�！秼D女研究論叢》為了體現(xiàn)立法者、不同領(lǐng)域?qū)＜液蛯?shí)際工作者對本《條例》修改的觀點(diǎn)和看法,特別設(shè)立本專欄,邀請各方面領(lǐng)導(dǎo)和專家參與討論,貢獻(xiàn)智慧,推動立法進(jìn)程。
[Abstract]:Since its promulgation in 1988, the provisions on the Protection of Women's Rights and interests have played an important role in the protection of women's rights and interests. However, under the background of social transformation and globalization in China, the principles and applicability established in the original "regulations" are challenged, which puts forward the requirements for further revision. In order to reflect this requirement, the regulations on the Labor Protection of female Workers (revised draft) have been discussed repeatedly, in the scope of their application, the standards of labour protection for female workers, the treatment of maternity insurance, the labor contract for female workers, Some important amendments have been made in legal liability, and constructive suggestions have been put forward to further guarantee the equal employment rights of female workers, the right to reproductive protection, the right to health and the legal right. While discussing and soliciting comments on the draft amendment to the regulations, further discussions will be held on the principles, basis, scope of application, degree of protection, maternity protection, and other contents that should be added to the revised regulations, It is of great significance.
