【摘要】：農(nóng)民工的權(quán)益保障越來越受到社會(huì)各界的普遍關(guān)注,農(nóng)民工工資拖欠行為一直在社會(huì)上蔓延,屢屢發(fā)生,尤其在建筑行業(yè)極為常見,侵害了農(nóng)民工的權(quán)益,影響了社會(huì)的穩(wěn)定。因此,杜絕農(nóng)民工工資拖欠行為是我們維護(hù)農(nóng)民工權(quán)益使其基本生活得到保障,促進(jìn)社會(huì)和諧發(fā)展的急需要解決的問題。 本文第一章闡述了研究背景及解決此問題的意義,總結(jié)了學(xué)者現(xiàn)有的研究綜述,以及對(duì)農(nóng)民工相關(guān)概念的界定。 第二章分析了建筑業(yè)拖欠農(nóng)民工工資的現(xiàn)狀,包括農(nóng)民工的工資特征,工資拖欠行為特征性分析以及表現(xiàn)形式,闡述了我國(guó)目前現(xiàn)存的對(duì)保護(hù)農(nóng)民工工資的法律法規(guī)。 第三章主要分析了工資拖欠行為存在的法律原因,理清存在問題的關(guān)鍵。 第四章闡述了從拖欠農(nóng)民工工資問題的基礎(chǔ)上,提出了相應(yīng)的法律解決措施,從根本上解決拖欠農(nóng)民工資問題。
[Abstract]:The protection of the rights and interests of migrant workers is paid more and more attention from all walks of life. The behavior of migrant workers' salary arrears has been spreading in the society, which occurs frequently, especially in the construction industry, which infringes the rights and interests of migrant workers and affects the stability of the society. Therefore, it is urgent for us to protect the rights and interests of migrant workers to ensure their basic life and promote the harmonious development of society. The first chapter describes the research background and the significance of solving this problem, summarizes the existing research review of scholars, as well as the definition of the relevant concepts of migrant workers. The second chapter analyzes the current situation of migrant workers' wages in arrears in construction industry, including the wage characteristics of migrant workers, wage delinquency behavior characteristics and manifestations, and expounds the existing laws and regulations to protect migrant workers' wages in our country. The third chapter mainly analyzes the legal reasons of wage arrears and clarifies the key problems. The fourth chapter expounds the problem of migrant workers in arrears on the basis of wages, put forward the corresponding legal solutions, fundamentally solve the problem of migrant workers in arrears.
