【摘要】：勞動爭議問題是當(dāng)今世界面臨的重大問題之一。在經(jīng)濟(jì)全球化的背景下，勞動爭議問題總是與工會所發(fā)揮的作用聯(lián)系在一起，正日益受到多種角度的關(guān)注。工會作為協(xié)調(diào)勞資糾紛的組織，在勞資糾紛之中應(yīng)該起到潤滑劑的作用，但是在現(xiàn)實過程中我國工會在處理勞動爭議過程中表現(xiàn)的是差強人意。本文在介紹我國工會法律制度的同時，希望通過對日本工會法律制度中所規(guī)定的工會職能進(jìn)行了比較研究，借鑒日本工會法律制度中長處，，為我國工會法律制度的改善盡綿薄之力。 本文分為四章，第一章介紹中日兩國的工會法律體系和勞動爭議處理制度，分別介紹了我國的工會法律體系和勞動爭議處理制度以及日本工會法律體系和勞動爭議處理制度。第二章分別介紹中日工會在勞動爭議中發(fā)揮的作用。第三章對中日兩國工會制度進(jìn)行比較，包括對工會經(jīng)費、人員構(gòu)成、三方機制以及集體勞動爭議制度的完善等方面比較，探求中日兩國工會在勞動爭議中發(fā)揮不同作用的原因。第四章基于第三章的分析的基礎(chǔ)上介紹日本工會在勞動爭議中所起的作用對于提高我國工會在勞動爭議中作用的借鑒。
[Abstract]:The issue of labor dispute is one of the major problems facing the world today. Under the background of economic globalization, labor disputes are always linked with the role played by trade unions, and are paid more and more attention from various angles. As an organization to coordinate labor disputes, trade unions should play the role of lubricant in labor disputes, but in the process of dealing with labor disputes, China's trade unions are not satisfactory. While introducing the trade union legal system of our country, this paper hopes to make a comparative study of the trade union functions stipulated in the Japanese trade union legal system, and draw lessons from the advantages of the Japanese trade union legal system. For the improvement of China's trade union legal system. This paper is divided into four chapters. The first chapter introduces the trade union legal system and labor dispute settlement system of China and Japan respectively. The second chapter introduces the role of Chinese and Japanese trade unions in labor disputes. The third chapter compares the trade union system between China and Japan, including the trade union funds, personnel composition, tripartite mechanism and the perfection of collective labor dispute system, and explores the reasons why the trade unions of China and Japan play different roles in labor disputes. The fourth chapter based on the analysis of the third chapter introduces the role of Japanese trade unions in labor disputes to improve the role of trade unions in labor disputes.
