【摘要】：目前勞動(dòng)者人事檔案糾紛主要表現(xiàn)為"扣檔"和"失檔",對(duì)勞動(dòng)者權(quán)益影響巨大。然而現(xiàn)行法律規(guī)定較為落后,不符合經(jīng)濟(jì)和勞動(dòng)力市場(chǎng)的發(fā)展需要,突出表現(xiàn)在人事檔案法律屬性定性落后和立法全方位缺位等方面。我們應(yīng)當(dāng)盡快改革并完善人事檔案制度,分類公檔案與私檔案,加快人事檔案的信息化和數(shù)字化建設(shè),完善現(xiàn)行立法,明確案件定性和程序,確定賠償規(guī)則和標(biāo)準(zhǔn)。
[Abstract]:At present, the personnel file dispute of laborer mainly shows as "deduct" and "lose file", which has great influence on workers' rights and interests. However, the current laws and regulations are relatively backward and do not meet the needs of the development of economy and labor market. The outstanding manifestations are the backward characterization of the legal attributes of personnel files and the absence of all aspects of legislation. We should reform and perfect the personnel file system as soon as possible, classify the public file and the private file, speed up the information and digitization construction of the personnel file, perfect the current legislation, define the nature and procedure of the case, and determine the rules and standards of compensation.
