【摘要】:職場(chǎng)性騷擾在我國(guó)已經(jīng)非常普遍,影響了多數(shù)的職場(chǎng)工作者的正常生活,《婦女權(quán)益保障法》《婦女保護(hù)特別規(guī)定》及《勞動(dòng)法》中的原則性規(guī)定顯然已經(jīng)不能滿足被侵權(quán)人的救濟(jì)訴求。從侵權(quán)責(zé)任法的角度,職場(chǎng)性騷擾已經(jīng)侵害了勞動(dòng)者的工作環(huán)境權(quán)與性自主權(quán)等基本權(quán)利,為了保護(hù)職場(chǎng)工作者的合法權(quán)利,本文研究職場(chǎng)性騷擾的侵權(quán)責(zé)任,分析討論職場(chǎng)性騷擾的侵權(quán)客體,歸責(zé)原則與責(zé)任方式,為職場(chǎng)工作者提供切實(shí)可尋的法律依據(jù)。 本文運(yùn)用文獻(xiàn)研究法,比較研究法,功能分析法等方法從侵權(quán)責(zé)任的構(gòu)成要件著手研究職場(chǎng)性騷擾的侵權(quán)責(zé)任認(rèn)定、歸責(zé)原則和損害賠償。本文第一部分主要是概述職場(chǎng)性騷擾的基本概念,因?yàn)樵谖覈?guó)法律文件中沒有明確的性騷擾概念界定,所以筆者運(yùn)用比較分析的方法列舉國(guó)內(nèi)外不同區(qū)域的法律界定,得出自己的觀點(diǎn)。第二部分主要依據(jù)侵權(quán)責(zé)任構(gòu)成要件的四個(gè)部分研究分析職場(chǎng)性騷擾侵權(quán)責(zé)任的構(gòu)成及與其他侵權(quán)行為的本質(zhì)區(qū)別。第三部分是對(duì)職場(chǎng)性騷擾侵權(quán)責(zé)任規(guī)制的侵權(quán)法完善,因?yàn)槲覈?guó)多數(shù)的文件都是原則性概括職場(chǎng)性騷擾,,并沒有明確被侵權(quán)人在遭受性騷擾后應(yīng)該投訴的部門和進(jìn)入訴訟程序后相應(yīng)的訴訟程序的完善。筆者建議完善懲罰賠償金制度和舉證責(zé)任制度,并且結(jié)合預(yù)防制度,提高法律對(duì)職場(chǎng)工作者的保護(hù)的實(shí)際操作能力。
[Abstract]:Sexual harassment in the workplace has become very common in our country. It has affected the normal life of the majority of workers in the workplace. The principle provisions in the Women's Rights and interests Protection Law and the Labor Law have obviously failed to satisfy the relief demands of the infringers. From the perspective of tort liability law, workplace sexual harassment has violated workers' basic rights such as the right to work environment and sexual autonomy. In order to protect the legitimate rights of workplace workers, this paper studies the tort liability of workplace sexual harassment. This paper analyzes and discusses the object of tort, the principle of imputation and the way of liability of sexual harassment in the workplace, and provides a practical legal basis for the workers in the workplace. The methods of functional analysis are used to study the tort liability determination, liability imputation and damage compensation of workplace sexual harassment from the constitutive elements of tort liability. The first part of this paper mainly summarizes the basic concept of sexual harassment in the workplace, because there is no clear definition of sexual harassment in the legal documents of our country, the author uses the method of comparative analysis to enumerate the legal definitions of different regions at home and abroad. Come up with your own point of view. The second part is mainly based on the four parts of the constitutive elements of tort liability to analyze the constitution of tort liability of workplace sexual harassment and the essential difference between it and other tort acts. The third part is the improvement of tort law on the regulation of tort liability for workplace sexual harassment, because most of the documents in our country summarize workplace sexual harassment in principle. It is not clear that the department where the infringer should complain after being sexually harassed and the perfection of the corresponding procedure after entering the legal procedure. The author suggests to perfect the system of punishment compensation and burden of proof, and to improve the practical operation ability of legal protection for workers in the workplace in combination with the system of prevention.
