我國家庭服務(wù)法律問題研究

【摘要】:家庭服務(wù)業(yè)是以家庭消費者為服務(wù)對象,,為滿足家庭生活中出現(xiàn)的各種需求,而向家庭提供不同種類勞務(wù)服務(wù)的行業(yè)。然而我國家庭服務(wù)市場存在很多問題:家庭服務(wù)員和家庭服務(wù)機構(gòu)市場準入門檻低,服務(wù)水平高低不等,家庭利益存在安全隱患;家庭服務(wù)員的權(quán)益保障落實難,就業(yè)穩(wěn)定性差;家庭服務(wù)機構(gòu)散亂、規(guī)模小實力弱。本文主要是從法律方面尋找產(chǎn)生這些問題的原因,并提出解決問題的建議。 第一章主要是分析我國家庭服務(wù)市場不同服務(wù)模式下存在的主要問題。以保姆虐嬰案為例介紹傳統(tǒng)式家庭服務(wù)模式及其問題,以家政服務(wù)員墜樓案為例介紹員工式家庭服務(wù)及其問題。本章將結(jié)合我國現(xiàn)有法學理論研究,分析案例中存在的法律關(guān)系,并歸納出案例爭議點,界定整篇文章的討論范圍是家庭服務(wù)法律保護問題。 第二章主要是分析我國家庭服務(wù)出現(xiàn)上述問題的法律原因。首先分析我國家庭服務(wù)法律保護的現(xiàn)狀是:沒有全國性法律規(guī)范,地方性法律規(guī)范也很少。我國家庭服務(wù)沒有被《勞動法》和《勞動合同法》納入調(diào)整范圍,主要接受民法規(guī)范的調(diào)整。其次是結(jié)合現(xiàn)有家庭服務(wù)法律規(guī)定,把家庭利益保護、家庭服務(wù)員權(quán)益保障、家庭服務(wù)保險制度和家庭服務(wù)機構(gòu)監(jiān)督管理等法律問題展開分析,以此說明我國家庭服務(wù)市場法律保護中具體制度的缺失。 第三章主要是分析如何對我國家庭服務(wù)法律保護進行完善。筆者認為應(yīng)從兩個方面來分析,首先是家庭服務(wù)法律體系方面的完善,把散工式、中介式家庭服務(wù)納入我國民法調(diào)整體系,把員工式家庭服務(wù)納入我國勞動法調(diào)整體系,并完善我國家庭服務(wù)行政法規(guī)則體系。其次是針對案例中體現(xiàn)出的具體問題提出家庭服務(wù)法律保護具體制度的完善建議,從家庭利益保護、家庭服務(wù)員權(quán)益保障、家庭服務(wù)保險制度和家庭服務(wù)機構(gòu)監(jiān)督管理機制等方面進行論述。
[Abstract]:The family service industry is a kind of service industry which takes the household consumer as the service object and provides different kinds of service to the family in order to meet the various needs in the family life. However, there are many problems in the domestic service market in China: the entry threshold is low for domestic waiters and family service organizations, the level of service varies, the family interests are hidden dangers, and the rights and interests of domestic waiters are difficult to implement. The employment stability is poor; the family service organization disorderly, the scale small strength is weak. This article is mainly from the legal aspect to find out the causes of these problems, and put forward some suggestions to solve the problems. Chapter one is mainly to analyze the main problems in different service models of the family service market in our country. Taking the babysitter case as an example, this paper introduces the traditional family service model and its problems, and takes the housekeeping attendant case as an example to introduce the employee family service and its problems. In this chapter, the author will analyze the legal relationship in the case, and conclude the dispute point of the case, combining with the existing legal theory research in our country. The second chapter is to analyze the legal reasons for the above problems in the family service in China. Firstly, it analyzes the current situation of the legal protection of family service in China: there are no national legal norms and few local legal norms. Family service in China is not regulated by Labor Law and Labor contract Law, and it is mainly regulated by civil law. The second is to analyze the legal issues such as the protection of family interests, the protection of the rights and interests of domestic waiters, the family service insurance system and the supervision and management of family service agencies in the light of existing family service laws and regulations. The third chapter mainly analyzes how to perfect the legal protection of family service in our country. The author thinks that it should be analyzed from two aspects: first, the perfection of the legal system of family service, the integration of casual and intermediary family service into the adjustment system of civil law, and the incorporation of employee family service into the adjustment system of labor law. And consummate our country family service administrative law rule system. Secondly, in view of the specific problems reflected in the case, the author puts forward some suggestions on the perfection of the specific system of legal protection of family service, from the protection of family interests and the protection of the rights and interests of domestic waiters. The system of family service insurance and the supervision and management mechanism of family service organization are discussed.
