【摘要】:農(nóng)民工是自80年代以來(lái)涌現(xiàn)的農(nóng)村剩余勞動(dòng)力向城鎮(zhèn)轉(zhuǎn)移而形成的一個(gè)特殊的社會(huì)群體。據(jù)國(guó)家統(tǒng)計(jì)局調(diào)查,目前我國(guó)農(nóng)民工人數(shù)已經(jīng)超過(guò)2億。由于我國(guó)長(zhǎng)期以來(lái)形成的城鄉(xiāng)二元分割體制,造成農(nóng)民工職業(yè)與身份的不一致性。從職業(yè)上看,農(nóng)民工已不再是從事農(nóng)業(yè)生產(chǎn)的農(nóng)民,而是在城市從事第二、三產(chǎn)業(yè)的工人,但從身份上看,他們?nèi)匀皇寝r(nóng)民,因?yàn)樗麄兊膽艏在農(nóng)村。這種不一致性導(dǎo)致農(nóng)民工在工作以及工作以外的諸多方面遭受著不平等的待遇,使得他們的許多合法權(quán)益得不到真正的保障。如何解決農(nóng)民工所面臨的這一系列問(wèn)題,近年來(lái),社會(huì)學(xué)者對(duì)此論述較多,而法學(xué)界則關(guān)注不夠。本文試從法學(xué)的角度對(duì)農(nóng)民工權(quán)利保護(hù)中的一個(gè)突出問(wèn)題——農(nóng)民工的勞動(dòng)權(quán)進(jìn)行深入探討。 本文共分為三大部分: 第一部分:農(nóng)民工與勞動(dòng)權(quán)概述。首先對(duì)農(nóng)民工進(jìn)行了界定。接下來(lái)從概念、性質(zhì)和內(nèi)容三方面對(duì)勞動(dòng)權(quán)作了全面梳理。最后論述了保護(hù)農(nóng)民工勞動(dòng)權(quán)的意義,指出保護(hù)農(nóng)民工的勞動(dòng)權(quán)是人權(quán)的內(nèi)在要求、是遵守國(guó)際勞工標(biāo)準(zhǔn)的要求、是構(gòu)建社會(huì)主義和諧社會(huì)的應(yīng)有之義。 第二部分:農(nóng)民工勞動(dòng)權(quán)的現(xiàn)狀及其法律原因分析。首先從農(nóng)民工的就業(yè)權(quán)受到嚴(yán)重侵害、勞動(dòng)報(bào)酬權(quán)嚴(yán)重受損、休息休假權(quán)得不到保障、勞動(dòng)安全衛(wèi)生權(quán)嚴(yán)重缺失、女職工和未成年工的特殊保護(hù)權(quán)未實(shí)現(xiàn)、職業(yè)培訓(xùn)權(quán)難得到保障、社會(huì)保險(xiǎn)權(quán)嚴(yán)重缺失、勞動(dòng)權(quán)受侵后得不到及時(shí)救濟(jì)、維權(quán)組織缺失九個(gè)具體方面對(duì)農(nóng)民工勞動(dòng)權(quán)的現(xiàn)狀作了描述。其間引用大量數(shù)據(jù)和調(diào)研資料作為實(shí)證。緊接著對(duì)農(nóng)民工勞動(dòng)權(quán)缺失的法律原因進(jìn)行了理論分析,對(duì)其中的立法、執(zhí)法和司法因素作了較深入的探討。 第三部分:加強(qiáng)農(nóng)民工勞動(dòng)權(quán)法律保護(hù)的思考。首先提出農(nóng)民工勞動(dòng)權(quán)保護(hù)的兩個(gè)原則——法律平等保護(hù)原則和法律特殊保護(hù)原則。嘗試從法理的高度論述農(nóng)民工勞動(dòng)權(quán)法律保護(hù)的理念。接著借鑒國(guó)外在解決相關(guān)問(wèn)題上的經(jīng)驗(yàn)做法,,進(jìn)行了比較研究。最后提出加強(qiáng)農(nóng)民工勞動(dòng)權(quán)法律保護(hù)的五條具體思路:一是要完善立法;二是要轉(zhuǎn)變政府職能,加強(qiáng)勞動(dòng)執(zhí)法;三是要改革和完善勞動(dòng)爭(zhēng)議處理機(jī)制:四是要提高農(nóng)民工的組織化程度;最后要為農(nóng)民工提供法律援助和普法宣傳。
[Abstract]:Migrant workers are a special social group formed by the shift of rural surplus labor force to cities and towns since 1980's. According to the National Bureau of Statistics survey, the number of migrant workers in China has exceeded 200 million. Because of the dualistic system of urban-rural division, the occupation and identity of migrant workers are inconsistent. From a professional point of view, migrant workers are no longer farmers engaged in agricultural production, but workers in the second and third industries in cities, but they are still peasants in terms of status, because their household registration is still in the countryside. Such inconsistency results in unequal treatment of migrant workers in many aspects of their work as well as outside of work, which makes many of their legitimate rights and interests not truly protected. In recent years, many social scholars have discussed how to solve this series of problems faced by migrant workers, but not enough in the field of law. In this paper, a prominent problem in the protection of the rights of migrant workers is discussed from the perspective of jurisprudence. This paper is divided into three parts: the first part: an overview of migrant workers and labor rights. First of all, the definition of migrant workers. Then the concept, nature and content of the three aspects of the overall combing of labor rights. Finally, it discusses the significance of protecting migrant workers' labor rights, and points out that the protection of migrant workers' labor rights is the inherent requirement of human rights and the requirement of complying with international labor standards. The second part: the status quo of migrant workers' labor rights and their legal reasons. First of all, the right to employment of migrant workers has been seriously violated, the right to remuneration has been seriously damaged, the right to rest and leave has not been guaranteed, the right to work safety and health has been seriously lacking, and the special protection rights of female workers and underage workers have not been realized. The right to vocational training is difficult to be guaranteed, the right to social insurance is seriously lacking, the right to work is not available for immediate relief after being invaded, and the current situation of migrant workers' labor rights is described in nine specific aspects of the absence of rights organizations. A large number of data and research materials are cited as empirical evidence. Then, the author makes a theoretical analysis of the legal reasons for the lack of migrant workers' labor rights, and probes into the legislative, law enforcement and judicial factors among them. Part three: the reflection on strengthening the legal protection of migrant workers' labor rights. Firstly, it puts forward two principles of labor rights protection of migrant workers-equal protection of law and special protection of law. This paper tries to discuss the concept of legal protection of migrant workers' labor rights from the perspective of legal theory. Then draw lessons from the experience of foreign countries in solving related problems, comparative study. Finally, five specific ideas for strengthening the legal protection of migrant workers' labor rights are put forward: one is to perfect the legislation, the other is to change the functions of the government and strengthen the labor law enforcement. Third, it is necessary to reform and improve the mechanism of handling labor disputes: fourth, to improve the degree of organization of migrant workers; finally, to provide legal aid and publicity for migrant workers.
