論勞動(dòng)合同的單方解除

【摘要】: 勞動(dòng)合同是用人單位和勞動(dòng)者簽訂的有關(guān)勞動(dòng)權(quán)利和勞動(dòng)義務(wù)的協(xié)議。勞動(dòng)合同是一種特殊的合同,它的訂立、變更、解除和終止對(duì)勞動(dòng)合同當(dāng)事人的利益影響重大。實(shí)踐中,大多有關(guān)勞動(dòng)合同爭議案件的發(fā)生都是由單方解除勞動(dòng)合同引起的,這是由于勞動(dòng)合同雙方對(duì)法律規(guī)定的理解不一致,以及勞動(dòng)合同解除立法上的缺陷,導(dǎo)致了用人單位和勞動(dòng)者濫用合同解除權(quán)的現(xiàn)象時(shí)有發(fā)生,嚴(yán)重?fù)p害了勞動(dòng)合同當(dāng)事人的利益,同時(shí)也不利于勞動(dòng)關(guān)系的穩(wěn)定。 本文運(yùn)用比較分析的方法,分四個(gè)部分對(duì)勞動(dòng)合同單方解除制度進(jìn)行了較為全面系統(tǒng)地分析與研究。第一部分探討了勞動(dòng)合同單方解除的法律原理,先對(duì)勞動(dòng)合同解除的概念及特征進(jìn)行了分析,然后通過勞動(dòng)合同單方解除與相關(guān)概念的比較,對(duì)勞動(dòng)合同單方解除的內(nèi)涵有了一個(gè)更加清楚的認(rèn)識(shí)。第二、三部分分別從用人單位單方解除勞動(dòng)合同和勞動(dòng)者單方解除勞動(dòng)合同兩個(gè)方面,對(duì)勞動(dòng)合同單方解除的法律規(guī)制作了研究。然后從比較法的角度,對(duì)國內(nèi)外有關(guān)勞動(dòng)合同單方解除立法進(jìn)行了分析和比較。最后,結(jié)合2006年3月全國人大常委會(huì)辦公廳全文公布的《中華人民共和國勞動(dòng)合同法(草案)》(下稱《勞動(dòng)合同法(草案)》) ,指出了《勞動(dòng)法》和《〈勞動(dòng)合同法(草案)》關(guān)于我國勞動(dòng)合同單方解除權(quán)制度的立法現(xiàn)狀及存在問題,并提出了自己的看法和建議,希望對(duì)我國勞動(dòng)立法的完善有所裨益。
[Abstract]:Labor contract is the agreement between employer and laborer about labor right and labor obligation. Labor contract is a kind of special contract. Its conclusion, modification, dissolution and termination have great influence on the interests of the parties to the labor contract. In practice, most of the disputes about labor contract are caused by unilateral termination of labor contract, which is due to the inconsistent understanding of the legal provisions between the two sides of the labor contract, as well as the defects in the legislation on the termination of the labor contract. It leads to the abuse of the right to rescind the contract by the employer and the laborer, which seriously damages the interests of the parties to the labor contract and is not conducive to the stability of the labor relations. In this paper, the method of comparative analysis is used to analyze and study the system of unilateral rescission of labor contract in four parts. The first part discusses the legal principle of unilateral termination of labor contract, first analyzes the concept and characteristics of the termination of labor contract, and then compares the unilateral termination of labor contract with related concepts. There is a clearer understanding of the connotation of unilateral termination of labor contract. Second, the third part studies the legal regulation of unilateral termination of labor contract from two aspects: unilateral termination of labor contract by employer and unilateral rescission of labor contract by laborer. Then from the angle of comparative law, this paper analyzes and compares the legislation of unilateral rescission of labor contract at home and abroad. Finally, in the light of the draft Labor contract Law of the people's Republic of China (hereinafter referred to as the Labor contract Law (draft) published in March 2006 by the General Office of the standing Committee of the National people's Congress, This paper points out the present legislative situation and existing problems of the system of unilateral rescission of labor contract in China, and puts forward its own views and suggestions, hoping to be of benefit to the perfection of labor legislation in China.
