【摘要】：正目前,很多企業(yè)對(duì)最低工資和最低生活費(fèi)的概念比較模糊,工人普遍認(rèn)為工廠沒(méi)活給我干,必須發(fā)給我本地區(qū)的最低工資,而不是最低生活費(fèi)。其實(shí),這只是一種片面的想法。因?yàn)?最低工資與最低生活費(fèi)雖有相同之處,但存在著本質(zhì)的區(qū)別。 《勞動(dòng)法》對(duì)最低工資有明確的定義,最低工資是指勞動(dòng)者在法定工作時(shí)間內(nèi),提供了正常勞動(dòng)的前提下,其所在用人單位應(yīng)當(dāng)支付的最低勞動(dòng)報(bào)酬。而最低生活費(fèi),是指從體力和智力上維持一個(gè)人的工作、學(xué)習(xí)和生活等日常活動(dòng)所需要的最基本支出�？梢钥闯�,最低工資與最低生活費(fèi)最根本的區(qū)別,是前者需要正常的勞動(dòng)才能獲得,而后者不需正常的勞動(dòng)就可得到。
[Abstract]:At present, many enterprises are vague about the concept of minimum wage and minimum living expenses. Workers generally believe that factories are not working for me and must pay me the minimum wage in the region instead of the minimum living expenses. In fact, this is only a one-sided idea. Because, although the minimum wage and the minimum living expenses have similarities, but there are essential differences. (Labor Law) has a clear definition of the minimum wage, the minimum wage refers to workers in the legal working hours, Provided the premise of normal labor, its place unit of choose and employ persons should pay minimum labor reward. The minimum living expenses refer to the basic expenses needed to maintain a person's daily activities, such as work, study and life, both physically and intellectually. It can be seen that the basic difference between the minimum wage and the minimum living expenses is that the former requires normal labor to obtain, while the latter can be obtained without normal labor.
