【摘要】：德國的勞動(dòng)者忠實(shí)義務(wù)源于人們對勞動(dòng)關(guān)系人身屬性特征的發(fā)現(xiàn),伴隨著雇主的照顧義務(wù)而產(chǎn)生。勞動(dòng)者忠實(shí)義務(wù)并非靜態(tài)的個(gè)體,而是一個(gè)靈活多變的義務(wù)群。隨著人身屬性在勞動(dòng)關(guān)系中所占比重的不斷變化,勞動(dòng)者忠實(shí)義務(wù)的數(shù)量和種類也隨之改變。在魏瑪政府時(shí)期勞動(dòng)者忠實(shí)義務(wù)達(dá)到發(fā)展的巔峰,但后來由于納粹政府的濫用而走下"神壇",被重新納入勞動(dòng)合同框架,并在日后的發(fā)展中逐漸衍生出以競業(yè)禁止義務(wù)、內(nèi)部勸解義務(wù)和保密義務(wù)為代表的眾多具體義務(wù)。并非任何勞動(dòng)者有損雇主利益的行為都將導(dǎo)致對忠實(shí)義務(wù)的違反,在訴訟程序、社會(huì)活動(dòng)以及公共利益保護(hù)中勞動(dòng)者將得到忠實(shí)義務(wù)的豁免。
[Abstract]:The duty of labor loyalty in Germany originates from the discovery of the personal attributes of labor relations and comes into being with the employer's duty of care. The laborer's duty of loyalty is not a static individual, but a flexible and changeable group of obligations. With the change of the proportion of personal attributes in labor relations, the quantity and types of laborer's duty of loyalty also change. During the period of Weimar government, the duty of loyalty of workers reached the peak of development, but later, due to the abuse of the Nazi government, they descended from the "shrine" and were reintegrated into the framework of labor contract, and gradually derived from the obligation of non-competition in the future development. The obligations of internal dissuasion and confidentiality represent many specific obligations. Not any worker who harms the interests of the employer will lead to a breach of the duty of loyalty, and workers will be exempted from the duty of loyalty in legal proceedings, social activities and the protection of the public interest.
