發(fā)達(dá)國家罷工權(quán)的演進(jìn)、實效與規(guī)制

【摘要】:發(fā)達(dá)國家勞動者的罷工權(quán)經(jīng)歷了從無到有的過程。在這個過程中,勞動者有組織的斗爭發(fā)揮了重要作用,資方也逐漸改變了對待罷工的態(tài)度。發(fā)達(dá)國家的政府更是作為勞資雙方之間的平衡力量,通過制定法律規(guī)范既確保了勞動者的罷工權(quán),使勞動者的利益訴求得到申訴;又規(guī)制了罷工,使之不對資方和社會產(chǎn)生較大的負(fù)效應(yīng)。承認(rèn)勞動者的罷工權(quán),并將罷工納入法制軌道,對于勞資合作與社會和諧都是重要的。
[Abstract]:The workers' right to strike in developed countries has gone through a process from scratch. In this process, the organized struggle of the labourers has played an important role, and the management has gradually changed the attitude towards the strike. The government of the developed countries is a balance force between the labor and capital, and through the formulation of legal norms, the workers' strike has been ensured. The right to appeal to the interests of the workers, and to regulate the strike, not to have a greater negative effect on the capital and the society. To recognize the right to strike the workers and to bring the strike into the legal track is important for both labor and capital cooperation and social harmony.
