【摘要】：以往工會(huì)性質(zhì)的研究更多地停留在政治學(xué)和社會(huì)學(xué)層面,主要從工會(huì)的階級(jí)性和群眾性的角度研究工會(huì)的性質(zhì),很少?gòu)姆傻慕嵌葋?lái)研究。工會(huì)的法律性質(zhì)是工會(huì)法律制度的邏輯起點(diǎn),工會(huì)的組織機(jī)構(gòu)、工會(huì)的職能、工會(huì)的權(quán)利與義務(wù)、工會(huì)的內(nèi)部法律關(guān)系和外部發(fā)生關(guān)系均由此產(chǎn)生,并由此決定。因此,研究工會(huì)的法律性質(zhì),不僅有著重要的理論意義,而且有著重大的實(shí)踐意義。
[Abstract]:In the past, the study of the nature of trade union stayed in the level of politics and sociology, mainly from the angle of class and mass of trade union, but rarely from the angle of law. The legal nature of the trade union is the logical starting point of the trade union legal system, the organization and organization of the trade union, the function of the trade union, the rights and obligations of the trade union, the internal legal relationship and the external occurrence relation of the trade union. Therefore, the study of the legal nature of trade unions not only has important theoretical significance, but also has great practical significance.
