【摘要】：【裁判要旨】與用人單位形成勞動關(guān)系的臨時工是勞動者,享有勞動法賦予勞動者的各項權(quán)利。因用人單位間業(yè)務(wù)劃轉(zhuǎn)致使勞動者被轉(zhuǎn)到新用人單位與新用人單位形成勞動關(guān)系的,勞動者在原用人單位的工齡應(yīng)合并計算為在新用人單位的工齡。
[Abstract]:The temporary worker who forms the labor relationship with the employer is a laborer and enjoys the rights conferred by the labor law. Because of unit of choose and employ persons business transfer causes laborer to be transferred to new unit of choose and employ persons and new unit of choose and employ persons form labor relation, laborer should combine the length of service of unit of former choose and employ persons to calculate for the length of service of new unit of choose and employ persons
