【摘要】:平等就業(yè)權(quán)是就業(yè)者平等地獲得和維持就業(yè)機(jī)會(huì)的權(quán)利,作為平等權(quán)和就業(yè)權(quán)的結(jié)合,平等就業(yè)權(quán)是一項(xiàng)具體人權(quán),它追求在平等基礎(chǔ)上的實(shí)質(zhì)平等,其核心內(nèi)涵是就業(yè)者有權(quán)平等享有就業(yè)的權(quán)利和資格、有權(quán)平等的參與就業(yè)機(jī)會(huì)的競爭,同時(shí)允許特定條件下的差別對待。解決就業(yè)問題、幫助就業(yè)者實(shí)現(xiàn)平等就業(yè),是關(guān)涉國計(jì)民生的大事,不僅有利于權(quán)利的保護(hù)與彰顯,也有利于人民生活水平提高、社會(huì)的和諧與穩(wěn)定。在當(dāng)前我國社會(huì)就業(yè)歧視泛濫、就業(yè)形勢嚴(yán)峻的形勢下,保障平等就業(yè)權(quán)尤顯必要。 然而當(dāng)前平等就業(yè)權(quán)的保障,存在著理論研究不足、制度設(shè)計(jì)不完善的雙重難題?v觀平等就業(yè)權(quán)的發(fā)展與保障實(shí)踐,國際上尤其是西方一些發(fā)達(dá)國家在平等就業(yè)權(quán)的理論創(chuàng)設(shè)、制度運(yùn)行等方面都已經(jīng)取得了相對豐富的經(jīng)驗(yàn),值得我們借鑒。自上世紀(jì)90年代以來,我國通過一系列的立法,在平等就業(yè)問題上形成了初步的法律制度體系,但是還存在著立法不完善、行政不充分、救濟(jì)不暢通等問題,使得當(dāng)前就業(yè)歧視盛行,就業(yè)者的平等就業(yè)權(quán)受到嚴(yán)重侵害。因此,當(dāng)前需要圍繞平等就業(yè)權(quán)保障的現(xiàn)狀與問題,從完善立法、加大執(zhí)法、強(qiáng)化司法等多個(gè)方面展開工作,以推動(dòng)平等就業(yè)權(quán)的法定化、制度化,實(shí)現(xiàn)對平等就業(yè)權(quán)的有效保障。 本文內(nèi)容分為四個(gè)部分: 第一部分闡述平等就業(yè)權(quán)及其實(shí)現(xiàn)原理。首先,從平等權(quán)和就業(yè)權(quán)這兩個(gè)基礎(chǔ)概念開始談起,界定平等就業(yè)權(quán)的概念和內(nèi)涵,分析平等就業(yè)權(quán)的性質(zhì)和效力。其次,闡述平等就業(yè)權(quán)的實(shí)現(xiàn)原理,包括平等就業(yè)權(quán)實(shí)現(xiàn)的一般特性、一般過程、制約條件、實(shí)現(xiàn)途徑等。 第二部分分析域外平等就業(yè)權(quán)保障的理論與實(shí)踐。由于平等就業(yè)權(quán)的理論發(fā)軔于西方,且國內(nèi)還沒有形成系統(tǒng)的平等就業(yè)權(quán)理論,故以域外的理論來對平等就業(yè)權(quán)保障的原理進(jìn)行闡述,并歸納總結(jié)域外的實(shí)踐經(jīng)驗(yàn)。在理論方面,主要分析平等權(quán)保障理論和反就業(yè)歧視理論這兩大保障平等就業(yè)權(quán)的基本理論及其應(yīng)用。在制度實(shí)踐方面,則從保障平等就業(yè)的立法、反歧視專門機(jī)構(gòu)、司法救濟(jì)機(jī)制、行政執(zhí)法和公眾參與機(jī)制等五個(gè)方面進(jìn)行總結(jié)性分析。 第三部分討論我國平等就業(yè)權(quán)的保護(hù)現(xiàn)狀與問題。本部分從現(xiàn)行法律保護(hù)制度、就業(yè)歧視現(xiàn)狀、與其它權(quán)利之間的沖突狀況等三個(gè)方面分析當(dāng)前我國平等就業(yè)權(quán)保護(hù)現(xiàn)狀;從平等就業(yè)權(quán)的立法缺陷、行政保護(hù)不力、救濟(jì)渠道不暢通等三個(gè)方面分析當(dāng)前阻礙我國平等就業(yè)權(quán)實(shí)現(xiàn)的主要因素。 第四部分探討我國平等就業(yè)權(quán)保障的制度設(shè)計(jì)問題。本部分在借鑒國外平等就業(yè)權(quán)保障經(jīng)驗(yàn),正視我國平等就業(yè)權(quán)保障存在的問題的基礎(chǔ)上,有針對性地提出完善平等就業(yè)權(quán)的憲法保護(hù)、建立統(tǒng)一完善的反就業(yè)歧視法律體系、加強(qiáng)行政保障機(jī)制建設(shè)、完善保障平等就業(yè)權(quán)的救濟(jì)機(jī)制等四個(gè)方面的措施來提高我國平等就業(yè)權(quán)的保障水平。
[Abstract]:The right to equal employment is the employment equality to obtain and maintain employment rights, as a combination of equal right and employment right, equal employment right is a specific human rights, it is the pursuit of equality on the basis of equality, the core content of employment has the right to enjoy equal employment rights and qualifications, have the right to equality participate in the employment competition, while allowing the specific conditions of the different treatment. To solve the employment problem, to help employees achieve equal employment, which is beneficial to the people's livelihood event, not only to protect and highlight the rights, but also conducive to the improvement of people's living standards, social harmony and stability. In the current social employment discrimination in our country flood the employment situation is grim, the situation under the protection of the right to equal employment is particularly necessary.
However, the guarantee of equal right to employment, there is a lack of theoretical research, the dual problem of imperfect design system. The development and practice of the protection of equal employment rights throughout the world, especially the creation of some western developed countries in the theory of equal employment rights, the system of operation has achieved a relatively rich experience, worthy of our reference since the last century. Since 90s, our country through a series of legislation, in the equal employment form legal system preliminary, but there are still imperfect legislation, inadequate administrative problems, relief is not smooth, so that the current employment discrimination, employment of equal employment right is infringed seriously. Therefore, to the present situation and problems of the current on the equal right to employment security, strengthen law enforcement from the perfect legislation, many aspects of work, strengthen judicial equality, to promote the industry right legalization of system The effective guarantee of equal employment right is achieved by the degree of degree.
The content of this article is divided into four parts:
The first part introduces the principle and Realization of equal employment right. First of all, from the two basic concepts of equal rights and employment rights began to talk about the concept and connotation of equal employment rights, nature and effect analysis of equal employment rights. Secondly, the principle of equal employment rights, general characteristics, including realization of equal employment rights the general process of constraints, the way to achieve.
The second part analyzes the theory and practice of extraterritorial equal employment rights protection. The equal employment rights theory originated in the west, and there is not a systematic theory of equal employment rights, so the principle of extraterritorial theory to equal employment rights protection is expounded, and summarizes the extraterritorial experience. In theory, the main analysis of equal rights of employment rights security theory and anti employment discrimination theory the two guarantee equal basic theory and its application in the system. In practice, the equal employment protection legislation, anti discrimination specialized agencies, judicial relief mechanism, five aspects of administrative law enforcement and public participation mechanism were retrospectively analyzed.
The third part discusses the current situation and problems of the protection of equal employment rights in our country. This part from the existing legal protection system, the current situation of employment discrimination, and three aspects of other rights conflict between the status analysis of China's current equal employment rights protection status; the right to equal employment from the legislative defect, administrative protection, relief channel is not smooth analysis of the three aspects of the main factors that hinder the realization of equal employment rights in China.
The fourth part discusses the system design of China's equal right to employment security. This part in foreign equal employment rights protection experience, to equal employment right of our country's security problems, put forward to perfect the constitutional protection of the right to equal employment, establish a perfect legal system of anti discrimination, strengthen the construction of the administrative safeguard mechanism, four aspects of perfect relief mechanism to ensure equal employment rights and other measures to improve the level of protection of equal employment rights in our country.
