【摘要】： 勞動(dòng)派遣是派遣機(jī)構(gòu)與派遣勞工訂立派遣契約,在得到派遣勞工的同意后,使其在要派企業(yè)的指揮監(jiān)督下提供勞務(wù)的勞動(dòng)形態(tài)�！肮蛡颉焙汀笆褂谩毕喾蛛x是勞動(dòng)派遣的最大特征,即派遣勞動(dòng)者與派遣機(jī)構(gòu)簽訂勞動(dòng)合同,卻在要派企業(yè)的指揮監(jiān)督下工作。 勞動(dòng)派遣的形態(tài)分為“經(jīng)常雇傭型”和“登錄型”兩種。經(jīng)常雇傭型的勞動(dòng)派遣是指派遣機(jī)構(gòu)將其雇傭的勞動(dòng)者派至要派企業(yè)提供勞動(dòng),此種類型的派遣勞動(dòng)者與派遣機(jī)構(gòu)之間的勞動(dòng)契約是屬于不定期勞動(dòng)契約。登錄型的勞動(dòng)派遣是指派遣機(jī)構(gòu)與派遣勞動(dòng)者之間并無(wú)不定期勞動(dòng)關(guān)系,派遣勞動(dòng)者僅是在派遣機(jī)構(gòu)處登記,直到有要派企業(yè)向派遣機(jī)構(gòu)提出人力需求,而該需求又符合派遣勞動(dòng)者的條件時(shí),派遣機(jī)構(gòu)方與派遣勞動(dòng)者簽訂派遣契約。我國(guó)目前大多采用登錄型勞動(dòng)派遣。 勞動(dòng)派遣是一種新型的勞動(dòng)法律關(guān)系,涉及到派遣單位、用工單位和派遣勞動(dòng)者三方當(dāng)事人,而目前的勞動(dòng)法理論體系和框架對(duì)這些法律關(guān)系無(wú)法完全容納和調(diào)整。因此,由于法律的缺失等一系列原因,我國(guó)派遣勞動(dòng)者權(quán)益保護(hù)存在差別待遇、雇主責(zé)任落實(shí)難度加大等諸多問(wèn)題。所以,我國(guó)應(yīng)在對(duì)日本、美國(guó)、德國(guó)、臺(tái)灣地區(qū)等有關(guān)勞動(dòng)派遣制度借鑒的同時(shí)根據(jù)我國(guó)的具體情況從派遣機(jī)構(gòu)的設(shè)立、勞動(dòng)派遣的適用范圍,勞動(dòng)派遣合同的期限,雇主責(zé)任的分擔(dān),保護(hù)派遣勞動(dòng)者的平等權(quán)、團(tuán)結(jié)權(quán)、福利保障權(quán)、接受教育訓(xùn)練等方面進(jìn)行勞動(dòng)派遣制度設(shè)計(jì),從而有效地保護(hù)派遣勞動(dòng)者的合法權(quán)利,充分發(fā)揮勞動(dòng)派遣的積極作用。
[Abstract]:Labor dispatch is the labor form in which the dispatch agency and the dispatched labor force conclude the dispatch contract and make them provide labor services under the command and supervision of the dispatching enterprise after obtaining the consent of the dispatched labor force.The separation of "employment" and "use" is the greatest characteristic of labor dispatch, that is, dispatch workers sign labor contracts with dispatch organizations, but work under the command and supervision of enterprises.The form of labor dispatch can be divided into two types: regular employment type and login type.The regular employment type of labor dispatch refers to the dispatch agency to send the workers to the enterprises to provide labor. The labor contract between this type of dispatch workers and dispatch agencies is an indefinite labor contract.Logged-in labor dispatch refers to the labor relationship between dispatch organization and dispatch worker. Dispatch worker is only registered with dispatch organization until an enterprise wants to send a manpower demand to dispatch organization.When the demand meets the conditions of dispatch workers, dispatch agencies sign dispatch contracts with dispatch workers.At present, most of our country use login labor dispatch.Labor dispatch is a new type of labor legal relationship, which involves three parties: dispatch unit, employment unit and dispatch worker. However, the current theoretical system and framework of labor law can not fully accommodate and adjust these legal relations.Therefore, due to the lack of laws and other reasons, there are many problems in the protection of the rights and interests of dispatched workers in China, such as differential treatment and the difficulty of implementing employer's responsibility.Therefore, while drawing lessons from the relevant labor dispatch systems in Japan, the United States, Germany, and Taiwan, China should, according to the specific conditions of our country, take into account the establishment of dispatch agencies, the scope of application of labor dispatch, and the duration of labor dispatch contracts.In order to protect the legal rights of the dispatched workers, the employer should design the labor dispatch system in the aspects of equal rights, solidarity rights, welfare protection rights, education and training, and so on, so as to protect the legal rights of the dispatched workers.Give full play to the positive role of labor dispatch.
