【摘要】:正案情簡(jiǎn)介劉某2001年1月1日被某皮塑公司招錄。2011年1月1日,公司考慮劉某在本單位工作已滿10年,依法與其簽訂了無(wú)固定期限勞動(dòng)合同。2011年3月,劉某在工作中不慎受傷,醫(yī)療期結(jié)束后作了工傷認(rèn)定和傷殘鑒定,傷殘等級(jí)為七級(jí)。2011年8月初,劉某向公司表示不解除勞動(dòng)關(guān)系,傷好后再回公司上班。8月底,劉某領(lǐng)取了一次性傷殘補(bǔ)助金。2012年9月10日,公司發(fā)出書(shū)面通知,要求劉某回公司上班,劉某以傷勢(shì)未痊愈不能勝任工
[Abstract]:On January 1, 2011, the company considered that Liu had already worked in his unit for 10 years and signed a labor contract with no fixed term according to law. In March 2011, Liu was accidentally injured in his work.After the end of the medical treatment period, he made the industrial injury identification and disability appraisal, and the disability grade was seven grades. In early August 2011, Liu Mou said to the company that he would not lift the labor relations, and returned to the company at the end of 8 months after the injury.Liu Mou received a one-time disability benefit. On September 10, 2012, the company issued a written notice requesting Liu to return to the company to work.
