【摘要】: 本文從對靈活就業(yè)制度的歷史淵源、理論與現(xiàn)實意義和理論、立法現(xiàn)狀的研究入手,對靈活就業(yè)進行了科學(xué)的法律定位和界定,對靈活就業(yè)法律關(guān)系的特點和類型等進行了系統(tǒng)的類型化研究,結(jié)合現(xiàn)代就業(yè)保障和就業(yè)公平機制等相關(guān)理論,緊緊圍繞靈活就業(yè)勞動法律關(guān)系和靈活就業(yè)法律制度展開深入論述。在此基礎(chǔ)上,通過對靈活就業(yè)制度進行價值考量,總結(jié)了其積極意義及消極影響,進而對靈活就業(yè)法律制度的宏觀運行和微觀操作進行細(xì)致總結(jié)和反思,并進一步對靈活就業(yè)法律制度的構(gòu)建提出了基本構(gòu)想,對該制度的突破和構(gòu)建進行對策分析,對其未來發(fā)展的深度和廣度進行預(yù)測研究。本文最后對其穩(wěn)定性、安全性和靈活性進行探討和反思。文章結(jié)合大量的表格,綜合運用了價值分析、文獻(xiàn)分析和比較分析等方法,資料豐富、內(nèi)容翔實,使本文對靈活就業(yè)勞動法律制度的研究更具理論性、可行性和獨特性。
[Abstract]:Starting with the study of the historical origin of flexible employment system, the theoretical and practical significance and theory, and the current situation of legislation, this paper makes a scientific legal orientation and definition of flexible employment.In this paper, the characteristics and types of flexible employment legal relationship are systematically studied, and the relevant theories such as modern employment security and employment equity mechanism are combined.Closely around flexible employment labor legal relationship and flexible employment legal system to carry out in-depth discussion.On this basis, through the value of flexible employment system, summed up its positive significance and negative impact, and then the flexible employment legal system macro operation and micro operation detailed summary and reflection.Furthermore, it puts forward the basic conception of the construction of flexible employment legal system, analyzes the breakthrough and construction of the system, and forecasts the depth and breadth of its future development.Finally, this paper discusses and reflects on its stability, safety and flexibility.Combined with a large number of tables, the paper makes use of the methods of value analysis, literature analysis and comparative analysis, which is rich in data and rich in content, which makes the study of flexible employment legal system more theoretical, feasible and unique.
