【摘要】:事業(yè)單位是計劃經(jīng)濟體制的產(chǎn)物,是具有中國特色的社會組織。在傳統(tǒng)的計‘劃經(jīng)濟體制下事業(yè)單位的職工擁有國家干部的身份,與單位之間是一種完全意義上的行政隸屬關系,在這樣的人事制度下事業(yè)單位不可能存在大量的人事爭議。2000年中央提出以推行聘用制度和崗位管理制度為重點,深化事業(yè)單位人事制度改革。聘用制使事業(yè)單位的人事管理由“身份”向“契約”轉變,不可避免地會帶來人才的流動,同時由于人事法規(guī)不完備、人事管理工作不規(guī)范以及聘用合同本身存在問題等諸多原因,使得事業(yè)單位的人事爭議時有發(fā)生。《勞動合同法》第96條首次明確將事業(yè)單位聘用關系納入勞動法律制度調整的范疇,彌補了事業(yè)單位聘用關系法律調整的空白。然而由于事業(yè)單位本身的法人性、公益性、非營利性和《勞動合同法》關于調整事業(yè)單位聘用關系的相關規(guī)則所存在的缺陷,事業(yè)單位聘用關系在法律適用上出現(xiàn)了困境。由此,我們應當考慮事業(yè)單位的特殊性,結合勞動法的基本精神,完善我國事業(yè)單位聘用關系調整的法律制度,以促進我國事業(yè)單位人事制度改革,更好地維護事業(yè)單位及其聘用人員的權益。 《勞動合同法》第96條規(guī)定首次將事業(yè)單位聘用關系納入法律調整視野,彌補了事業(yè)單位聘用關系法律調整的空白。本文通過評析《勞動合同法》第96條,探索了我國事業(yè)單位聘用關系的法律適用問題。文章首先對我國事業(yè)單位和事業(yè)單位聘州制度作了簡要閘述;其次,在對《勞動合同法》第96條進行解讀的基礎上,研究了我國事業(yè)單位聘用關系現(xiàn)行法律適剛問題及面臨的困境;第三,文章論述了將事業(yè)單位聘刷關系納入《勞動合同法》調整的可行性問題。最后文章就如何完善事業(yè)單位聘刪關系法律制度提出了一些可行性建議。 由于國內學術界對事業(yè)單位聘用制研究多數(shù)局限于事業(yè)單位性質與聘用制度關系的界定以及改革方向的理論分析,缺乏對聘用制度法律關系的追蹤探討,本文首次結合事業(yè)單位聘用制度的特點以及事業(yè)單位改革的實踐,對事業(yè)單位聘用制度法律的適用進行整體、系統(tǒng)的研究,因而具有非常之意義。
[Abstract]:The business unit is the product of the planned economic system, has the characteristics of social organization. Chinese have cadres of the state institutions in the traditional planed economy system of the workers, and between units is the administrative relationship in a complete sense, under such personnel system under the institution may not exist the personnel dispute.2000 Central Committee put forward focusing on the employment system and job management system, deepen the reform of personnel system. The employment system and institutions and personnel management is changing from "identity" to "contract", will inevitably bring about the flow of talent at the same time, because the personnel regulations are not complete, the personnel management is not standardized and employment the contract itself is a problem for many other reasons, the institution of personnel disputes have occurred. The labor contract law > ninety-sixth is clear for the first time the public institutions employment relationship Included in the labor legal system to adjust the category, fill a gap in employment in Institutions of legal regulation. However, due to legal institutions, the public, the defects about the rules and institutions to adjust the employment relationship and labor contract law > < non-profit institutions, employment difficulties arising in the application of the law. Therefore, we should consider the special nature of institutions, combined with the basic spirit of the labor law, perfecting the legal system of China's public institutions employment relationship adjustment, in order to promote the reform of personnel system, to better safeguard the institutions and their staff's rights and interests.

With the analysis of < Labor Contract Law > ninety-sixth, explores the legal problems of public institutions employment relationship of our country. Firstly, China's institutions and institutions employment system is briefly described; secondly, based on the interpretation of the" labor contract law "article ninety-sixth, the research institutions of our country employment relationship existing legal problems and difficulties faced by the optimum stiffness; third, the article discusses the institution employment relationship into a feasibility problem < Labor Contract Law > adjustment at last the article puts forward some feasible suggestions for legal system on how to improve the relationship between delete institutions.
The analysis of the domestic academic study on public institutions employment is largely confined to the relationship between the system of institution and definition of employment and the reform direction of the theory, the lack of study on the legal relationship of employment system for the first time tracking, combined with the practice of the reform of the system of employment in institutions and institutions of public institutions employment system, the application of the law overall, systematic research, and has great practical significance.
