勞動法中的違約金與賠償金問題研究

【摘要】:在我國的《勞動法》中,并沒有對違約金、賠償金進行明確的規(guī)定,雖然關(guān)于違約金制度的研究有很多,但是涉及到勞動法領(lǐng)域的違約金研究則比較少,只是簡單的提到;而關(guān)于賠償金的研究,大多局限于懲罰性賠償,還沒有拓展到勞動法領(lǐng)域,各個方面都不完善,在這種情況下,對我國勞動法中的違約金、賠償金相關(guān)問題進行深入研究顯得很有必要。
[Abstract]:In the "Labor Law" of our country, there is no clear stipulation of liquidated damages and compensation. Although there are many researches on the system of liquidated damages, there are few researches on liquidated damages in the field of labor law, which are simply mentioned.However, most of the research on compensation is limited to punitive damages, which has not been extended to the field of labor law, and all aspects are not perfect. In this case, the penalty for breach of contract in the labor law of our country,It is necessary to study the related problems of compensation.
