論我國職工帶薪年休假法律制度完善

【摘要】:帶薪年休假制度是憲法和法律用以保障人權(quán)的重要措施之一,自頒布法條施行至今,雖有成效但是在實(shí)踐中仍然存在著許多問題。從帶薪年休假的目的和意義出發(fā),休假是為了保障勞動(dòng)者的身心健康,從而建設(shè)精神文化。同時(shí),勞動(dòng)者在休假的時(shí)候也會(huì)進(jìn)行相應(yīng)的經(jīng)濟(jì)活動(dòng),也對我國經(jīng)濟(jì)產(chǎn)生貢獻(xiàn)并促進(jìn)其發(fā)展。因此完善并落實(shí)帶薪年休假制度有著重要的意義。本文主要分為四個(gè)部分來論述我國帶薪年休假制度的問題。第一部分主要分析我國現(xiàn)階段的帶薪年休假在立法制度現(xiàn)狀,在立法制度上主要從三個(gè)方面進(jìn)行論述,分別從帶薪年休假的安排方式、對未休年休假的補(bǔ)償問題和法律責(zé)任的相關(guān)規(guī)定上論述我國的立法現(xiàn)狀。第二部分主要對現(xiàn)階段帶薪年休假制度存在的問題進(jìn)行分析論述。參照第一部分論述的三個(gè)方面分別進(jìn)行詳細(xì)的討論,指出了現(xiàn)階段我國帶薪年休假在制度設(shè)計(jì)中存在的缺陷。第三部分主要參考了域外帶薪年休假相關(guān)的制度,通過分析法國、德國和日本三個(gè)國家的具體帶薪年休假制度的規(guī)定,從中選擇適合中國國情的規(guī)定予以借鑒和完善存在的問題。第四部分主要對上述提出的問題進(jìn)行完善和解決,其中這部分也分為三個(gè)方面:其一,對于我國帶薪年休假的安排方式上存在的問題,提出設(shè)立每工作滿一年增加一天的年休假直至25天為止的休假天數(shù)的計(jì)算模式,由此提高我國帶薪年休假的休假天數(shù),并明確規(guī)定年休假連休制度;其二,對于我國未休年休假補(bǔ)償?shù)墓べY報(bào)酬的性質(zhì)需明確為勞動(dòng)報(bào)酬,適用特別時(shí)效,從而能夠保障勞動(dòng)者的權(quán)利;其三,對法律責(zé)任的完善,則需要通過民事責(zé)任和行政責(zé)任進(jìn)行雙重保護(hù)。在民事責(zé)任方面需要對不同事由的不安排年休假的法律責(zé)任進(jìn)行詳細(xì)的區(qū)分;對不安排約定年休假的法律責(zé)任需要適用有利于勞動(dòng)者的原則處理。在行政責(zé)任方面,則需要取消責(zé)令改正的規(guī)定,從而進(jìn)一步加強(qiáng)監(jiān)管機(jī)關(guān)的行政責(zé)任。
[Abstract]:The system of paid annual leave is one of the important measures used by the Constitution and law to protect human rights. Since the enactment of the law, although it has been effective, there are still many problems in practice. Vacation is to protect workers' physical and mental health and thus to build a spiritual culture. At the same time, workers will also engage in corresponding economic activities when they are on vacation. It also contributes to our economy and promotes its development. Therefore, it is of great significance to perfect and implement the annual paid leave system. This paper is divided into four parts to discuss the problems of paid annual leave system in China. The first part is the main part. In order to analyze the current situation of the legislative system of annual paid leave in our country, The legislative system is mainly discussed from three aspects, respectively, from the arrangement of annual leave with pay, The present legislative situation of our country is discussed in terms of the compensation of unpaid annual leave and the relevant provisions of legal liability. The second part mainly analyzes the problems existing in the current paid annual leave system. Three aspects are discussed in detail. This paper points out the defects in the system design of annual paid leave in China at present. The third part mainly refers to the system related to annual leave with pay abroad, and analyzes the specific regulations of paid annual leave system in three countries, France, Germany and Japan. The fourth part is mainly to perfect and solve the problems raised above, and this part is also divided into three aspects: first, With regard to the problems existing in the arrangement of annual leave with pay in our country, this paper puts forward a calculation model of the number of days of annual leave with pay up to 25 days per full year of work, so as to increase the number of days of annual leave with pay in our country. And clearly stipulate the system of continuous vacation; second, the nature of compensation for unpaid annual leave in our country should be defined as labor compensation, the application of special statute of limitations, so as to protect the rights of workers; third, the perfection of legal liability, It needs double protection through civil liability and administrative liability. In the aspect of civil liability, it is necessary to make a detailed distinction between the legal liability without annual leave for different reasons; It is necessary to apply the principle in favor of the laborer to deal with the legal liability of not arranging annual leave. In the aspect of administrative liability, it is necessary to cancel the stipulation of ordering correction, so as to further strengthen the administrative responsibility of the supervisory organ.
