我國公共就業(yè)服務(wù)法律制度研究

【摘要】:我國是一個人口大國,就業(yè)問題的解決對于社會經(jīng)濟(jì)的可持續(xù)發(fā)展以及和諧社會的建設(shè)都具有重大的意義。如何通過建立起完善的公共就業(yè)服務(wù)制度以及相應(yīng)的法律制度來解決我國的就業(yè)問題,是一個重要的課題。論文分析了我國公共就業(yè)服務(wù)的概況,指出了《就業(yè)促進(jìn)法》的不足之處,探索如何更好的建構(gòu)我國的公共就業(yè)服務(wù)法律制度,以便于建立和諧的社會勞動關(guān)系。 論文的第一章是緒論部分,從選題背景、問題提出和研究意義闡述了探索和構(gòu)建我國公共就業(yè)服務(wù)法律理論體系的重要性。第二章論述了公共就業(yè)服務(wù)與勞動市場法的關(guān)系,對比公共就業(yè)服務(wù)在澳大利亞、美國、日本對于本國勞動市場法的影響,提出我國公共就業(yè)服務(wù)在當(dāng)前的不足之處,并在此基礎(chǔ)上,歸納了勞動力市場改革的國內(nèi)原因,提出在當(dāng)前形勢下公共就業(yè)服務(wù)的功能應(yīng)隨之發(fā)生相應(yīng)的變化。為了保證公共就業(yè)服務(wù)的順利開展,就需要配套的法律明確其保護(hù)內(nèi)容及法律責(zé)任的承擔(dān)。第三章針對這一問題,對公共就業(yè)服務(wù)法律制度的建構(gòu)做了論述。分析了我國以《就業(yè)促進(jìn)法》為主的公共就業(yè)服務(wù)法律制度的現(xiàn)狀,重點對公共就業(yè)服務(wù)法律制度的基礎(chǔ)進(jìn)行了深入研究,通過對就業(yè)服務(wù)權(quán)、公共就業(yè)服務(wù)的功能作用、政府責(zé)任三個問題的理解,提出了完善公共就業(yè)服務(wù)法律制度的必要性。第四章提出了建立完備的公共就業(yè)服務(wù)體系以及合理的公共就業(yè)服務(wù)管理模式,并對我國公共就業(yè)服務(wù)法律制度的構(gòu)建給出了建設(shè)性意見。 論文通過對我國公共就業(yè)服務(wù)法律制度的現(xiàn)狀和面臨的挑戰(zhàn)進(jìn)行分析,研究如何完善我國的公共就業(yè)服務(wù)法律制度,以便更好的促進(jìn)就業(yè)困難群體的就業(yè),緩解就業(yè)壓力。作為我國目前保障就業(yè)服務(wù)主要的適用法,《就業(yè)促進(jìn)法》是構(gòu)建我國和諧勞動關(guān)系的重要法律。但是在這部關(guān)系民生的法律中也存在著一些需要完善的地方。一方面需要通過法律的約束,實施積極的就業(yè)政策,促進(jìn)社會經(jīng)濟(jì)與就業(yè)的協(xié)調(diào)發(fā)展,另外一方面還要采取積極地就業(yè)培訓(xùn)機(jī)制,形成以勞動者自主就業(yè)為基礎(chǔ),以市場調(diào)節(jié)就業(yè)為主導(dǎo),以政府促進(jìn)就業(yè)為保障的就業(yè)機(jī)制,創(chuàng)造盡可能好的就業(yè)環(huán)境,才能提升相對弱勢勞動者的就業(yè)能力,使其成為勞動力市場的平等主體,形成權(quán)利與義務(wù)對等的和諧勞動關(guān)系。
[Abstract]:China is a populous country, The solution of employment problem is of great significance to the sustainable development of social economy and the construction of harmonious society. How to solve the employment problem of our country by establishing a perfect public employment service system and corresponding legal system, This paper analyzes the general situation of the public employment service in China, points out the shortcomings of the Employment Promotion Law, and explores how to better construct the legal system of the public employment service in our country. In order to facilitate the establishment of harmonious social labor relations. The first chapter of the thesis is the introduction part, from the background of the topic, the question raised and the significance of the research, the paper expounds the importance of exploring and constructing the legal system of the public employment service in our country. The second chapter discusses the relationship between the public employment service and the labor market law. Comparing the influence of public employment service in Australia, America and Japan on the labor market law of our country, this paper puts forward the deficiency of our country's public employment service at present, and on this basis, sums up the domestic reasons of labor market reform. In order to ensure the smooth development of public employment service, the function of public employment service should change accordingly under the current situation. Regarding the need for supporting laws to clarify the content of their protection and the commitment of their legal responsibilities. Chapter III deals with this issue. This paper discusses the construction of the legal system of public employment service, analyzes the present situation of the legal system of public employment service, which is dominated by the Employment Promotion Law, and focuses on the foundation of the legal system of public employment service. Through the understanding of the right of employment service, the function of public employment service and the responsibility of government, The author puts forward the necessity of perfecting the legal system of public employment service. Chapter 4th puts forward the establishment of a complete public employment service system and a reasonable management mode of public employment service. It also gives constructive suggestions on the construction of the legal system of public employment service in China. Through the analysis of the current situation and challenges of the legal system of public employment service in China, this paper studies how to perfect the legal system of public employment service in order to better promote the employment of the group with difficulty in employment. As the main applicable law of protecting employment service in our country at present, the Employment Promotion Law is an important law to construct harmonious labor relations in our country. However, there are some needs in this law which relates to people's livelihood. Perfect place. On the one hand, it needs to be restricted by law, To implement an active employment policy and promote the coordinated development of social economy and employment, on the other hand, we must adopt an active employment training mechanism to form a foundation based on the independent employment of workers and take the market regulation of employment as the leading factor. The employment mechanism, which is guaranteed by the government to promote employment, can improve the employment ability of the relatively weak laborer, make it the equal subject of the labor market, and form the harmonious labor relationship of equal rights and obligations.
