中國(guó)集體談判法制建構(gòu)

【摘要】:集體談判是市場(chǎng)經(jīng)濟(jì)條件下調(diào)整勞動(dòng)關(guān)系的主要手段,是市場(chǎng)經(jīng)濟(jì)國(guó)家勞動(dòng)關(guān)系制度的核心內(nèi)容。集體談判法制包括集體談判法律體系、集體談判法的理念、創(chuàng)制、適用、遵守和解釋,它對(duì)確立、保護(hù)和發(fā)展集體談判的作用有重要意義。本文主要從集體談判法律體系、法律意識(shí)、法律創(chuàng)制這幾個(gè)集體談判法制最為重要的問(wèn)題入手對(duì)建構(gòu)我國(guó)集體談判法制進(jìn)行研究,并提出初步的方案。 我國(guó)目前有關(guān)集體談判的立法非常薄弱,集體談判法制還沒(méi)有建立起來(lái),這對(duì)保護(hù)勞動(dòng)者行使集體談判權(quán)非常不利。本文從三個(gè)方面入手對(duì)構(gòu)建我國(guó)集體談判法制的幾個(gè)重要問(wèn)題作了分析。首先是分析集體談判法制的構(gòu)成。集體談判法制要服務(wù)于發(fā)揮集體談判制度的作用,它的基本價(jià)值指向是保護(hù)勞動(dòng)者的生存權(quán)和發(fā)展權(quán),為了實(shí)現(xiàn)這個(gè)價(jià)值,它的基本原則應(yīng)該是:權(quán)利制衡原則、誠(chéng)信原則、自治原則和禁止權(quán)力濫用原則。國(guó)家確立何種方式調(diào)整勞動(dòng)關(guān)系對(duì)建構(gòu)集體談判法制有決定性影響。如果采取協(xié)約自治模式調(diào)整勞動(dòng)關(guān)系,則通過(guò)建構(gòu)集體談判法制保證集體談判制度的運(yùn)行是必要的。但是如果國(guó)家采取統(tǒng)合模式調(diào)整勞動(dòng)關(guān)系,則從功能上講,集體談判沒(méi)有存在的價(jià)值,也就談不到建立集體談判法制。通過(guò)比較和分析兩種調(diào)整模式,本文提出建立符合中國(guó)國(guó)情的“有序參與”的調(diào)整模式,為集體談判立法奠定了邏輯前提。有關(guān)集體談判的國(guó)際法已經(jīng)比較系統(tǒng),我國(guó)對(duì)集體談判的立法應(yīng)該參考國(guó)際人權(quán)法框架,履行我國(guó)的公約義務(wù),縮小我國(guó)法律保護(hù)水平與國(guó)際人權(quán)法規(guī)范之間的差距。最后,在我國(guó)集體談判立法模式的選擇上,綜合分析了集體談判法與我國(guó)現(xiàn)有的勞動(dòng)法在立法原則、調(diào)整的勞動(dòng)關(guān)系的區(qū)別后,本文認(rèn)為,集體談判法有自己的獨(dú)立性,不能被現(xiàn)行勞動(dòng)法涵蓋,應(yīng)該進(jìn)行單行立法。
[Abstract]:Collective bargaining is the main means to adjust the labor relations under the condition of market economy and the core content of the labor relations system in the market economy countries. The legal system of collective bargaining includes the legal system of collective bargaining and the concept of collective bargaining law. Creation, application, compliance and interpretation are of great significance to the establishment, protection and development of the role of collective bargaining. The most important problems of collective bargaining legal system are established by law. The author studies the construction of collective bargaining legal system in our country and puts forward a preliminary plan. At present, the legislation on collective bargaining in China is very weak, and the legal system of collective bargaining has not yet been established. This is very unfavorable to the protection of workers' right to collective bargaining. This paper analyzes several important problems in the construction of the legal system of collective bargaining in China from three aspects. Firstly, it analyzes the constitution of the legal system of collective bargaining and the constitution of the legal system of collective bargaining. The legal system should serve to play the role of collective bargaining system. Its basic value is to protect workers' right to survival and development, in order to realize this value, its basic principles should be: the principle of balance of rights, the principle of good faith. The principle of autonomy and the principle of prohibiting abuse of power. The way that the state establishes the adjustment of labor relations has a decisive influence on the construction of the legal system of collective bargaining. It is necessary to guarantee the operation of collective bargaining system by constructing the legal system of collective bargaining, but if the state adopts the integration mode to adjust the labor relations, there is no value of collective bargaining in terms of function. Through the comparison and analysis of the two adjustment models, this paper puts forward the adjustment model of "orderly participation" in accordance with the national conditions of China. For collective bargaining legislation laid a logical premise. Collective bargaining in international law has been more systematic, our collective bargaining legislation should refer to the framework of international human rights law, the implementation of our obligations under the Convention. Reduce the gap between the level of legal protection and international human rights law norms. Finally, on the choice of the legislative model of collective bargaining, the author comprehensively analyzes the legislative principles of collective bargaining law and the existing labor law of our country. After adjusting the difference of labor relations, this paper holds that collective bargaining law has its own independence, can not be covered by the current labor law, and should carry out separate legislation.
