【摘要】：2012年的金秋時(shí)節(jié),蘭州新區(qū)從眾多的競(jìng)爭(zhēng)對(duì)手中脫穎而出,成為全國(guó)第五個(gè)國(guó)家級(jí)新區(qū)。從建設(shè)伊始,蘭州新區(qū)就承載了蘭州市拓寬城市空間、甘肅省振興經(jīng)濟(jì)發(fā)展、國(guó)家打造向西開(kāi)放重要平臺(tái)的一系列重要使命。而如何抓住國(guó)家“一帶一路”的發(fā)展機(jī)遇,如何讓蘭州新區(qū)在發(fā)展初期就注重規(guī)避開(kāi)發(fā)區(qū)在發(fā)展過(guò)程中面臨的發(fā)展問(wèn)題,則需要我們?cè)谔m州新區(qū)建立初期就做好規(guī)劃,做好頂層的制度設(shè)計(jì),這其中既包括經(jīng)濟(jì)政策的支撐,也包括法律制度的支持。唯有如此,才能為蘭州新區(qū)經(jīng)濟(jì)的良性發(fā)展提供制度支撐,才能將依法治國(guó)的執(zhí)政理念切實(shí)的運(yùn)用到實(shí)際的發(fā)展過(guò)程之中,走一條高效、規(guī)范的新區(qū)發(fā)展之路,實(shí)現(xiàn)蘭州新區(qū)五位一體的重要發(fā)展目標(biāo)。本文旨在通過(guò)對(duì)開(kāi)發(fā)區(qū)立法的基本理論進(jìn)行研究,結(jié)合國(guó)內(nèi)外開(kāi)發(fā)區(qū)的立法經(jīng)驗(yàn),立足中國(guó)當(dāng)前的法制環(huán)境,以蘭州新區(qū)建設(shè)過(guò)程中的實(shí)際情況為依據(jù),提出一些蘭州新區(qū)法律支持體系建設(shè)的構(gòu)想。本文主要從以下幾個(gè)方面對(duì)蘭州新區(qū)法律支持問(wèn)題進(jìn)行闡述：第一部分為緒論,主要介紹選題背景、研究目的及意義、文獻(xiàn)綜述以及研究方法、內(nèi)容和創(chuàng)新點(diǎn)。第二部分為文章正文,其中第一章,主要介紹蘭州新區(qū)的成立以及發(fā)展現(xiàn)狀,分析蘭州新區(qū)發(fā)展限制性因素,并對(duì)蘭州新區(qū)立法理論進(jìn)行相應(yīng)介紹；第二章,通過(guò)從蘭州新區(qū)法律支持現(xiàn)狀出發(fā),分析目前法律供給不到位之處,并分析原因；第三章,對(duì)國(guó)內(nèi)外主要開(kāi)發(fā)區(qū)的法律支持經(jīng)驗(yàn)進(jìn)行介紹,以期對(duì)蘭州新區(qū)的法律支持構(gòu)建提供寶貴的經(jīng)驗(yàn)借鑒；第四章,依據(jù)所面臨的問(wèn)題提出相應(yīng)的解決建議。第三部分結(jié)論,對(duì)上述幾章進(jìn)行總結(jié),提出不足和展望。
[Abstract]:In the autumn season of 2012, Lanzhou New area stands out from many competitors and becomes the fifth national new area in the country. From the beginning of the construction, Lanzhou New area has carried a series of important missions of widening the urban space of Lanzhou, revitalizing the economic development of Gansu Province, and building an important platform for opening up to the west in Gansu Province. And how to seize the development opportunity of the country's "Belt and Road" and how to let Lanzhou New area pay attention to evading the development problems faced by the development zone in the early stage of development requires us to make a good plan in the early stage of the establishment of Lanzhou New area. Do a good job of top-level institutional design, which includes the support of economic policy as well as the support of the legal system. Only in this way can we provide institutional support for the benign development of the economy in Lanzhou New area, can we effectively apply the ruling idea of ruling the country according to law to the actual development process, and take a high-efficient and standardized road to the development of the new district. To realize the important development goal of five-in-one in Lanzhou New area. The purpose of this paper is to study the basic theory of the development zone legislation, combine the legislative experience of domestic and foreign development zones, base on the current legal environment in China, and take the actual situation in the construction process of Lanzhou New area as the basis. Put forward some ideas on the construction of legal support system in Lanzhou New area. This paper mainly expounds the legal support of Lanzhou New area from the following aspects: the first part is the introduction, mainly introduces the background of the topic, the purpose and significance of the research, literature review, research methods, content and innovation. The second part is the text of the article, the first chapter mainly introduces the establishment and development status of Lanzhou New area, analyzes the restrictive factors of Lanzhou New area development, and introduces the legislative theory of Lanzhou New area accordingly. The second chapter, starting from the current situation of legal support in Lanzhou New area, analyzes the lack of legal supply at present, and analyzes the reasons; The third chapter introduces the legal support experience of the major development zones at home and abroad in order to provide valuable experience for the construction of legal support in Lanzhou New area. The fourth chapter puts forward the corresponding solutions according to the problems faced. The third part of the conclusion, the above-mentioned chapters are summarized, put forward the shortcomings and prospects.
