【摘要】：航空客運承運人的附隨義務是指航空承運人為更好的履行航空旅客運輸合同,基于雙方的誠信原則為或不為一定的行為。承運人的附隨義務源于民法中的“誠實信用原則”,不同于主給付義務、從給付義務、先合同義務、后合同義務,有著自己獨特的性質。我國航空立法中對于承運人附隨義務做了相關規(guī)定,包括告知旅客乘機信息、告知安全注意信息、告知超售事宜、協(xié)助殘疾旅客登機、協(xié)助安排食宿、保密旅客個人信息等義務。本文將其歸納分類,并且總結出在航空司法實踐中應當適用法定、約定優(yōu)先原則、利益均衡原則、適當限制原則等來進行附隨義務的認定。航空客運承運人違反附隨義務的責任屬于廣義上的合同責任,其不同于單純的違約或侵權責任。認定責任時應當采用過錯責任原則,采用舉證責任倒置的方式以保證實質上的公正。航空承運人違反附隨義務的,旅客可采取相關方式進行權利上的救濟,包括損害賠償、請求繼續(xù)履行、或者解除合同等等。
[Abstract]:The accompanying obligation of air passenger carrier refers to the behavior of air carrier for better performance of air passenger transport contract based on the principle of good faith between the two parties. The subsidiary obligation of the carrier originates from the principle of good faith in civil law, which is different from the principal payment obligation, the subordinate obligation, the first contract obligation, the later contract obligation, and has its own unique nature. China's aviation legislation has made relevant provisions on carrier's accompanying obligations, including informing passengers of boarding information, informing safety attention information, informing oversold matters, assisting passengers with disabilities in boarding, and helping to arrange accommodation and board. Duty to keep confidential passenger's personal information, etc. This paper generalizes and classifies it and concludes that in the practice of aviation judicature we should apply the principle of legality agreement priority principle of balance of interests and principle of appropriate restriction to identify the collateral obligation. The liability of air passenger carrier for breach of collateral obligation belongs to contract liability in broad sense, which is different from simple breach of contract or tort liability. The principle of fault liability and the inversion of burden of proof should be adopted to ensure substantive justice. If an air carrier violates its accompanying obligations, the Guest may take appropriate measures to remedy the rights, including damages, requests for continued performance, or termination of the contract, etc.
