智能手機(jī)預(yù)置應(yīng)用軟件行為法律規(guī)制研究

【摘要】:隨著科學(xué)技術(shù)的快速發(fā)展,智能手機(jī)在人們的生活中占據(jù)了越來越重要的地位。無論是在工作學(xué)習(xí)、還是在娛樂休閑方面,手機(jī)的智能功能都給用戶帶來了簡單而便捷的使用體驗。智能手機(jī)在一定程度上改變了社會大眾的生活方式,已成為現(xiàn)代社會人們?nèi)粘I钪胁豢苫蛉钡囊徊糠。?yīng)用軟件的使用是智能手機(jī)區(qū)別于普通手機(jī)的重要表現(xiàn)形式。通過使用安裝在智能手機(jī)上的應(yīng)用軟件,人們可以獲得有別于傳統(tǒng)的娛樂、休閑體驗。近年來,應(yīng)用軟件的運用越來越廣泛,呈現(xiàn)出個性化和全面化的趨勢。應(yīng)用軟件的廣泛使用,給人們帶來全新體驗的同時,也帶來了新的法律問題。消費者在購買智能手機(jī)時,往往面臨著并不清楚智能手機(jī)中預(yù)置了應(yīng)用軟件或預(yù)置應(yīng)用軟件無法卸載、甚至存在惡意行為的現(xiàn)實問題,嚴(yán)重地侵犯了消費者的合法權(quán)益。因此,對于預(yù)置應(yīng)用軟件行為的研究,需要分析預(yù)置應(yīng)用軟件行為的法律界定,明確預(yù)置應(yīng)用軟件行為法律規(guī)制的價值取向,并且考察預(yù)置應(yīng)用軟件行為的法律規(guī)制理論基礎(chǔ)。在現(xiàn)實中,預(yù)置應(yīng)用軟件行為可能存在危害性,但我國現(xiàn)有的法律規(guī)制還有所欠缺,應(yīng)在現(xiàn)有基礎(chǔ)上對其加以完善,尋求消費者多元化的救濟(jì)方式。為了對智能手機(jī)中預(yù)置應(yīng)用軟件這一行為準(zhǔn)確定性,需要在法律層面上對其定義、分類、構(gòu)成要件及特征進(jìn)行界定。經(jīng)營者作為市場經(jīng)濟(jì)活動的主體,為了營利而實施預(yù)置行為無可厚非。事實上,預(yù)置應(yīng)用軟件行為其本身是中性的,但若預(yù)置行為將消費者的合法權(quán)益作為犧牲品,那么在法律上就會得到否定性的評價,其實施主體則應(yīng)承擔(dān)相應(yīng)的法律責(zé)任。在當(dāng)前市場環(huán)境下,立法應(yīng)當(dāng)在相應(yīng)的理論基礎(chǔ)上,權(quán)衡經(jīng)營者的預(yù)置利益和消費者的基本權(quán)益的輕重,最終以保護(hù)消費者權(quán)益為核心價值取向。不合乎法規(guī)的預(yù)置行為對消費者、其他智能手機(jī)經(jīng)營者以及正常的市場競爭秩序都有所危害。但由于智能手機(jī)預(yù)置應(yīng)用軟件行為是科技進(jìn)步的產(chǎn)物,因此現(xiàn)行立法難以對其進(jìn)行充分的約束,這就需要對現(xiàn)行的法律規(guī)制進(jìn)行分析,并提出其存在規(guī)制依據(jù)不健全、行政監(jiān)管不到位、行業(yè)自律缺失以及救濟(jì)途徑不暢四個方面的問題。針對上述現(xiàn)狀和問題,需要在智能手機(jī)預(yù)置應(yīng)用軟件行為法律規(guī)制方面提出相應(yīng)的對策建議,首先,將消費者權(quán)益保護(hù)作為核心強(qiáng)化規(guī)制的價值取向;其次,擴(kuò)容升位,制定相關(guān)的法律法規(guī)對該問題進(jìn)行一般性的指導(dǎo),并配以具體的法律措施;第三,強(qiáng)化行政監(jiān)管和行業(yè)自律雙管齊下的監(jiān)管體系;最后,以調(diào)整證據(jù)責(zé)任為突破來暢通救濟(jì)渠道,以期全面保護(hù)消費者的合法權(quán)益。
[Abstract]:With the rapid development of science and technology, smart phone plays an increasingly important role in people's life. In the aspect of work and study, entertainment and leisure, the smart function of mobile phone brings users a simple and convenient experience. To some extent, smart phone has changed the way of life of the public, and has become an indispensable part of people's daily life in modern society. The use of application software is an important form of expression that distinguishes smartphones from ordinary mobile phones. By using apps installed on smartphones, people can have a different entertainment and leisure experience. In recent years, application software is more and more widely used, showing the trend of individuation and comprehensiveness. The wide use of application software brings new experience to people, but also brings new legal problems. When consumers buy smart phones, they often face the problem that they can not uninstall or uninstall the pre-installed application software or pre-set application software in the smart phone, which seriously infringes the legitimate rights and interests of consumers. Therefore, to study the behavior of preset application software, we need to analyze the legal definition of preset application software behavior, clarify the value orientation of legal regulation of preset application software behavior, and investigate the theoretical basis of legal regulation of preset application software behavior. In reality, the behavior of preset application software may be harmful, but the existing legal regulations in our country are still lacking, which should be perfected on the basis of the existing to seek a diversified remedy for consumers. In order to define the pre-set application software in smart phone, it is necessary to define its definition, classification, constitutive elements and characteristics at the legal level. Operators as the main body of market economy activities, for profit and the implementation of preset behavior is not to blame. In fact, the behavior of preset application software is neutral, but if the behavior of preset takes the legitimate rights and interests of consumers as the victim, then it will get negative evaluation in law, and the subject of its implementation should bear the corresponding legal responsibility. In the current market environment, the legislation should balance the pre-set interests of the operators and the basic rights and interests of consumers on the basis of corresponding theories, and finally take the protection of consumers' rights and interests as the core value orientation. Irregular preset practices are harmful to consumers, other smartphone operators and the normal market competition order. However, the behavior of smart phone preset application software is the product of scientific and technological progress, so it is difficult for the current legislation to restrict it, which requires an analysis of the existing legal regulations, and proposes that the existing regulatory basis is not perfect. Administrative supervision is not in place, industry self-discipline is lacking and relief channels are not smooth. In view of the above situation and problems, we need to put forward the corresponding countermeasures and suggestions on the behavior regulation of smart phone preset application software. Firstly, take the protection of consumers' rights and interests as the core value orientation of strengthening regulation; Second, expand the position, formulate relevant laws and regulations to give general guidance to this issue, and match with specific legal measures; third, strengthen the regulatory system of administrative supervision and industry self-discipline. Finally, to adjust the burden of evidence as a breakthrough to smooth relief channels, in order to fully protect the legitimate rights and interests of consumers.
